Timeline

Technical question.

My wife (USC) is concerned about changing jobs. My interview isnt until the 24th of Aug. I will be continuing on to higher education so we will have to move. Wife has not been able to find a job in the new location as yet but was considering moving anyway and then trying to find a job locally once we were in the area. Is this allowed or is this a breach of the I-864?

I am not sure where she saw it, but she thinks that she needs to have continuous employment until the 40 credits that the intending immigrant needs to obtain has been reached. She does not want to break her contract to the government.

The way I see it, I imagine that she is responsible until the 10 years is up and as a result we cannot get any assistance or if we do, we have to pay it back. Hence, it doesn't matter if she is without a job for a short while.

So any advice on this would be appreciated.

05/03/10 - Sent AOS Package

05/05/10 - Package Delivered

05/10/10 - NOA's Receipt Notice - text, email

05/12/10 - Hardcopy NOAs Received

05/14/10 - Touched (Forms I-485, I-130 & I-765)

05/17/10 - Biometrics letter (Appt set for June 8) - No Walk in allowed at my center

06/07/10 - Request for initial information (Joint sponsor forget to include 1099 and W2; silly me forget to check his package)

06/08/10 - Biometrics appt (went in at 10 for 12 appt; went smooth)

06/14/10 - Initial information sent to USCIS (delivery set for 06/18)

06/18/10 - Request for additional initial information (I-864A needed for wife of Joint sponsor)

06/29/10 - Initial information sent to USCIS (I-864A and supporting documents)

07/01/10 - Initial information delivered to USCIS

07/16/10 - Employment authorization card has been ordered. Wait 30 days for delivery.

07/21/10 - Form i-797 for Interview appointment. interview set for Aug 24th

08/24/10 - Interview at 9 am. Arrived: 8:30am. Called in: 8:55. Inteview done :9:02am. Approved.

09/03/10 - Green card received in the mail. Valid for 2 years. It is done, at least for now.

I just answered you in another thread, but you are right, not your wife. She's only on the hook if you receive certain government benefits.

I just answered you in another thread, but you are right, not your wife. She's only on the hook if you receive certain government benefits.

Sorry about the double post. I could not find the original post cause it was posted in the wrong section. Still not sure how i got there. Thanks for the reassurance. I am thinking though that she should not put in her 2 weeks notice until after we have our interview. That way we dont give them something to give us trouble about.

Yes, that makes sense. At the interview, it's good for both of you (if possible) to be employed.
