Baby born abroad to LPR parent

I am an LPR and my wife is in her home country,she has been scheduled a visa interview in the embassy.I am requesting the embassy for a re-scheduling of the interview,probably for a month later since she is 9 mo pregnant.

Can anyone educate us,what is the procedure for grant of visa to the newborn,if he needs one.Doe we have to take him to the embassy?

Someone in this forum,different thread,said He won't need a visa.We are confused?

Has anyone gone through all this?

Why is it a problem to contact the embassy in question to ask about your specific case? Will take away the confusion.

The embassy back there is not cooperating.

Emails are going unreplied.

PLS READ MY PREVIOUS POST SINCE WE HAVE SAME CASE. I HAD MY SON WHEN I WAS IN THE PHILIPPINES. IVE POSTED THE WHOLE STORY. PM ME IF YOU STILL MORE INFO.

------USCIS-- married since March 28, 2005 - I130 filed: july 27, 2007

NOA #1: Aug 6, 2007 NOA #2: Oct. 29, 2009 - APPROVED

--NVC--December 12, 2009 - Case# generated from NVC

December 17, 2009 - hubby received his letter from NVC[/font]

April 13, 2010 - received DS-3032 via email

April 19, 2010 - sent back DS-3032 to NVC thru DHL (did not email a copy)

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!

Once born take the baby to the interview and he will be processed along with your wife's visa. She will be asked if she's the mother and if she wants to take her baby with her when traveling. If she decides to travel with the baby she will be asked to fill out the DS-230 form for the baby, pay the visa fee and do a medical test for the baby, and visa will be issued for both your wife and soon.

I have heard before on this forum,the baby doesn't need a visa.This is confusing.I know all this confusion will go away once the embassy clarifies this but they are not answering.

The baby doesn't need a visa if one of the parent is a USC, all you have to do is report the birth of the child at the consulate.

In your case it's not so....so baby will get a visa.

Children born abroad to permanent resident mothers are permanent residents.

The requirements are that such a child must be brought to the U.S. on the mother's first return trip, which must occur before the child is two years of age.

As of this writing, the child in this situation does not need a visa.

Good to know was not aware of that...I notice that it was posted back in 2003. Anyway all the best and please do keep us posted as i'm curious to know. My sister went thru the same thing back in 2009 and the baby had to pay the visa fee and was given a green card.
