Hi, first of all I'm not sure if I'm on the right category in posting these questions. VJ Admins, you may move this post any time.

I feel like I might have quite a complicated situation and please if any of you have experienced this, pls feel free to comment and give suggestions or tell me what happened in your case.

So here it goes, we're still waiting for the K1 visa interview but I have some questions on advance parole or travelling while waiting for AOS.

My dad will be travelling to FL to attend my wedding under a B2/Tourist Visa. My sister is currently living and is a citizen of Canada. My sister might not be able to attend my wedding. So she is planning for all of us to visit her and her family around two weeks AFTER my wedding. First, I know my husband-to-be won't have any problems crossing the border. Dad has Canadian Tourist Visa as well. My sister will send me an invitation to visit her, but I still don't have my Canadian Visa. BUT let's just say I will be approved to visit..

My questions are:

1. Will I be allowed to go with them using Advance Parole?

2. From what I know, forms are needed to be mailed off to request for AP? How long does it usually take for us to receive any notification back?

BTW, we're only planning to stay in Ontario for maximum of two weeks or maybe less.

17 Jan 2013 - Receive reminder mail from USCIS to file I-751

09 Feb 2013 - Mailed complete I-751 packet

11 Feb 2013 - Packet Delivered to Vermont

14 Feb 2013 - Check Cashed

18 Feb 2013 - Receive NOA in the mail for I-751 (says conditional status extended for another year, yay!)

Im sorry if Im not much help..All I know is that you can not leave the US untill your AP is approved.

You can send your AP Form I-131 with you AOS packet..

Im not sure how long it takes, I guess it all depends on if they need more info from you after you send out all you forms.

My husband and I are still waiting because we were asked for more information.

My husband received his AP in 10 weeks from filing AOS. I doubt you can get AP within the first month of applying. I would not take a chance to travel outside the USA.

6/2/2010- Case received/resumed at CSC

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

Im sorry if Im not much help..All I know is that you can not leave the US untill your AP is approved.

Hi April! It's okay, thanks for replying. It's just paperworks are incredibly complicated. Hit me back on the status/updates of your AP. I might leave by January of next year, so I'm just doing some research and asking around. Thanks again :)

OMG, I feel so sorry for her. God bless her. Thanks for sharing and for the reply. I will tell my sister about this. I guess we just need to wait before I could visit her.

Timeline

If you travel without the AP paperwork in hand for your return, USCIS considers that you abandoned the AOS process and you will not be allowed back into the country. Under no circumstance try to travel without the AP paperwork (Form I-512) in hand. When you get your I-797 NOA paperwork back acknowledging receipt of your I-131 application (at no additional cost presuming you filed the I-131 application when you filed for the I-485 AOS) it will tell you that you will hear back generallly within 60-90 days from receipt of your I-131 application. If you look at the timelines on this site for AP, you will see it's running about 66 days. We just received ours and the approval was granted 69 days after receipt of paperwork; it took another 9 days to actually receive the AP form, because they did not mail it until 5 days after the approval. If you have not yet signed up on the www.USCIS.gov site to set up an account and track your case status, you should do this. Good luck! Kurt

10/16/09 Submitted DS-2100 and Ds-230 to apply for interview date. 10/23/09 Received Interview date (had to call DOS)

12/09/09 Interview - VISA GRANTED!!!!!!!!!!!!!!!!!!!!!!

1/07/10 Arrived in Miami, cleared Immigration with no problems. Arrived in Charlotte to a freaking cold spell 55 degrees colder than Dora has ever experienced.
