No money no petition??

I am a 22 year old female from Virginia USA. i met my fiance in the philippines 2005, and weve been together for 5 years. we have a 2 year old daughter. I went to school in the philippines, met a great guy, had a daughter now need to head home The problem is, i have no income yet. once arriving i will get a job, more or so, Nursing assistant until i pass my NCLEX to be a registered nurse. I want to petition my fiance.. but how..? Now my question is are Co sponsors allowed for K1 visas? Or should him and I get married so that i can use a co sponsor in a spouse visa. (my mother and father are willing to co sponsor) but the question is will the uscis understand?, any one else in my situation?

As far as I know you can have more than one co-sponsor on a K-1. If you get married you have one advantage over the K-1 though and that's an immediate permanent resident status when he enters the states and he gets a green card. It's also a little more affordable.

If you get married in the Philippines, it sounds like you've lived there quite a while no? You could apply for a CR-1 visa at the embassy, which take less time to process and he could even come home with you. You can also have more than one co-sponsor on a CR-1 visa.

I don't have a solid income at the moment, I do have a job lined up though, and they had no problems with my parents co-sponsoring. They approved the petition with no questions asked. :)

Manila Embassy is really picky on Co-Sponsors. Since you are young and have recently completed "higher education" they are generally accepting of that as it means you have a higher future earning potential.

Just remember the co-sponsor will need to have enough income to support your spouse in addition to all of the members of their household at 125% of the current poverty guidelines.

I assume you reported your son's birth to the Embassy in Manila already (CRBA) so he has a US Passport.

Generally accepting in such situations, yes but two issues.

1. One parent is the sponsor, not both and must qualify for the entire household based on their own personal income, not joint income. Choose the parent who qualifies.

2. Affidavit of support is not included in the petition, so you may well qualify on your own by the time the affidavit is carried to the interview 5 to 7 months after filing.

I don't know how Virginia is but after I completed nursing school I couldn't find a job for the life of me, they want people with experience. And especially in this economic climate there are a lot of retired nurses going back, and since they have the experience they get the preferential treatment....Good luck to you though

thanks everyone.. we plan on getting married before i leave to make things a bit easier for us financially and make the filing easier for me . where can i get these forms? ive been in the philippines for a little over 4 years. i went to school here. but am heading home this september so i really doubt that he can come home with me, but i wish he could. if i knew all this info a loooong time ago,we would have gotten married earlier. thanks again.

Wouldn't you qualify for Direct Consular filing? Check it out in the visa Guide GL

As long as her presence there is all legal she should be able to but September is almost upon them. Maybe if she can stay there a few more months to see the process through then they can return together.
