I originally sent in a copy of my short form birth certificate for the I-485 with my AOS package. After receiving the NOAs and my case being moves from Chicago to Missouri, I called USCIS and told them of my mistake. The operator told me to send in a copy of my long form birth certificate with a copy of the NOA for my I-485 without receiving a RFE.

Questions:

I am currently on an H1-B visa, will this mistake with the birth certificate make a difference or will they process my case with the short form birth certificate?

Will this mistake slow down my process time?

Will they still send me a RFE asking for my long form birth certificate even though I sent one in already?

It has been 16 days since my package was received and I haven't received a biometrics appointment, can this be due to the mistake with my birth certificate?

Thanks

I'm not an expert, but here are the answers as I see things. Someone can correct me if I am wrong.

1. They may or may not accept your short form bc. I didn't know there was a difference, so I just sent the one I had which is half a page. We were approved without problem.

2. If indeed they do need your long certificate, your process may be somewhat delayed (usually around a month or less).

3. It is very possible that you will get an RFE because it is generally advisable not to send in missing information without a copy of the RFE since they often do not link the new paperwork with your file. I know that is what the operator told you to do, but USCIS is not always smart about putting old paperwork with new submissions.

4. 16 days is not very long to wait for a biometrics appointment. You will probably hear from them in the next couple of weeks or so.

My case was a K1, so it is possible that there are some differences in processing times and procedures, but hopefully this information was helpful. It is probably best to wait to hear something from them regarding an RFE or hopefully just an outright approval. Good luck!

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from a visa other than a K1, K2, K3 & K4 which the prior forum is for**
