DCF IN FRANCE 2 please help!!!!

Hello,

I'm a newbie, so can someone help me? :P

My girlfriend is a usc, i'm a french citizen.

We're in love and we would like to marry. I'm living in France, she's living in Usa...

So, we would like to live both together in Usa.

I've heard about the dcf...

So here's my question...

Does she has to be a french resident or just be phisycally present at the petition?

The ambassy website is pretty contadictory...

Please help!!!

May 27 th 2008: USCIS received my AOS pack( i-485,I-130, I-785...etc)

June 4th 2008: Checks cashed!

June 7th 2008: received NOA for I-130, I-485, I-765, case is in the nbc

June 10th 2008: received biometric letter

June 21th 2008 : Biometrics Done

IMPORTANT NOTICE:

The Immigrant Visa (IV) unit of the U.S. Embassy in Paris will receive in-person general inquiries and requests for information on Fridays ONLY. Beginning Friday, September 1st, 2006 the hours will change to a starting time of 9:00a.m. Please note that admissions end at 10:00 a.m. and interested parties should arrive well before that hour to ensure they will be admitted. We request that you appear in person, as we are unable to respond to phone, e-mail, or letter inquiries. We will accept all interested parties that arrive between 9:00 and 10:00 a.m.

The U.S. Embassy in Paris can accept immigrant petitions from U.S. citizens in France who wish to petition any Immediate Relative (IR) or Family Based qualifying relative.

U.S. citizens not resident in France, filing for beneficiaries who are French citizens or French legal permanent resident, may either file their petition at their nearest USCIS office in the U.S., or file, in person, at the U.S. Embassy in Paris. Both the petitioner and the beneficiary must be present at the filing of the petition.

Effective September 1st, 2006, the Consular Section of the American Embassy in Paris accepts immigrant visa petitions on Fridays only starting at 9:00 a.m. Petitioners and beneficiaries must arrive at the Consular Section (2, rue Saint-Florentin; metro: Concorde) between the hours of 9:00 and 10:00 a.m. in order to ensure entry. There will be no admissions after 10:00 a.m. Appointments are not granted and petitioners will be seen on a first-come, first-serve basis. "

Ils disent que elle doit envoyer le dossier aux États si elle n'est pas une residente de la France... alors... je croyais que ca veut dire elle doit etre une residente pour faire DCF.

Et avant vous allez essayer le DCF, vous devez etre marier...

ici il y a une fiche qui dit qu'est-ce qu'elle doit avoir pour son dossier d'apporter avec elle à la France.

Je pense c'est mieux si tu vas appeller le consulat pour verifier la question de residence avant vous allez acheter les billets... il faut pas perdre l'argent pour rien :)

Quelle autre page? J'ai vu y a plein des consulats à la france...

Je vois que c'est un peu difficile de prendre le residence pour elle par mariage... les papiers vont caisser la tete no?... y a plein de bureaucracie :lol: ...est-ce que tu sais combien ca va prendre pour la carte de séjour ?

o.k. ici un example -

vous etes fiancé ---> vous allez envoyer un K-1 fiancé - ça va prendre peut etre entre 6-9 mois pour ton visa - apres tu es venu aux etats tu dois envoyer AOS (Adjustment of Status), mais tu dois attendre 3 mois pour l'autorisation de travailler, et tu dois prendre AP si tu veux rendre visite en France.

vous etes marié ---> vous allez envoyer un K-3 (I-130 + I-129F) - ça va prendre un peu plus que le visa fiancé - mais tu dois pas attendre EAD pour travailler, et tu dois pas prendre AP (permission de sortir et rentrer aux États) - apres tu es venu aux etats tu dois envoyer AOS (Adjustment of Status)

vous etes marié ---> vous allez faire un CR-1/IR-1 -- ça va prendre plus de temps que les autres, mais tu peux travailler tout de suite aux Etats, tu peux sortir et rentrer aux Etats comme tu veux et tu dois pas envoyer AOS.

ou il y a DCF - c'est tres vite... mais.. si vous pouvez pas marier tres vite (à cause de loi en france)...

à mon avis... DCF c'est le millieur choix pour un(e) américain(e) qui a déjà le residence en france, et par hasard ils ont fait la connaissance avec leur mari/femme en france...

Je connais pas bien le loi de marier en France, alors qu'est-ce que tu veux choisir.. c'est ton decision..

à mon avis c'est plus facile de marier aux Etats. vous pouvez etre marier dans 1 seule journée si tu as ton passeport et elle a ses documents..

The USC does not need to be resident in France to file I-10 for their *spouse*.

It does not matter if you marry in France or in the US. US is easier/faster.

:o Notre K-1 ca marche pas trop vite... mais c'est a cause d'un nouveau loi aux etats pour les compagnies qui font les sites internet pour les connaissances avec les etrangers avec les citoyens aux etats... mais on attend encore.

I just copied and pasted what I read from the Consulate in Paris. It hinted that non residents had to file through USCIS... but there were a couple other places that seemed to say the opposite thing. I recommended calling the consulate directly and ask them flat out. I told him that marrying in France is a bureaucratic mess and depending on their processing time for obtaining residence (carte de séjour) in France, there may be other options that could be better. I do agree marrying in the states is easy, with a valid passport one can marry in one day.

Hello, I married a US citizen last year in the US. I am now living in France and he is living in the US. I will go next week to the US consulate to get more info about the DCF.

PS: getting married in the US is ultra simple. Take some time to check what is needed by the 'marriage bureau' of the city in the US where you want to get married. Some cities have more requirements than other. Plus check the French consulate web site overthere to bring from France all the documents needed if you want to legalize your marriage in France as well.
