03/03/2015: I-797C, Notice of Action received

03/26/2015: Fingerprints done!

08/24/2015: Notice of Action received, Interview letter!

09/28/2015: Interview day, PASSED! Oath Ceremony same day :)

This is correct. The airline probably sold the seat to a standby passenger and forgot to update their passenger manifest. Unfortunately, if the airline says he boarded that flight then, as far as USCIS is concerned, he boarded that flight.

I think the best place to start is by contacting the airline. Perhaps if they can confirm that the seat was sold to someone else then an appeal or petition to reopen might be filed on that basis.

This is the first time I've ever heard of a round trip ticket backfiring on someone. It really sucks. :angry:

There was a similar report recently. As in recent, it seems I recall reading it here within the last three months. I'm sorry to say I can't recall the member name.

I was also thinking maybe you could get his employer to write a letter stating he's worked there from x date to x date - sort of further proof that he would have had to have been in the country when they said he'd left.

Call the airline and cancel the return ticket. That way the airline can't inadvertently attach you name to the standby passenger they will (if you don't cancel) eventually sell your seat to.
