Timeline

How long does it usually take from the NOA until you receive the biometrics letter?

It roughly takes around 20 days from the date of filing for you to get the biometrics letter, usually, looking at my experience and most other timelines.

There are cases where it could take much longer, but this is the average!

6-29-2010 Got Married!

08-10-2010 Sent AOS Package to Chicago Lock-Box..

08-24-2010 Received texts/emails of acceptance, Finally!

ok, so mine should be here any day. we filed on Aug. 25 and the package was delivered in Chicago on the 27th.

Received our RFE letter today :( Affidavit of support not meeting the 125% poverty guidelines. Does anyone knows if the petitioner owns a business at the same time employed, how do you compute the income? We have combined my husband's (USC) Individual income form 1040 and his partnership income form 1065 and the total was more than it requires in the guidelines. His individual income alone is not sufficient and short by few thousands but this is only for Y2009. In the previous year he made good $ enough to support us. We have included his payslips for the past 3 months and a letter from his employer in the current year which is more than enough but still we got an RFE :(

Is having a joint sponsor the best solution for this? As much as possible we didnt want to have a joint sponsor since we thought what he makes currently is enough already since it is more than 125% of the poverty line.

Any advice will be very much appreciated.

As per advice received from other VJ members i have computed my husband's income wrongly. I should not added the amount in form 1040 and form 1065. It should be line 22 of form 1040 only which is really below the poverty guideline.

Best option is to have a co-sponsor

Hi VJ ers ,

We filled my AOS EAD and AP package along with the I 130

We sent the package to Chicago lock box on Aug 14th and we got 4 NOAs for our applications on August 17th.

There is no news on our case after that. The last updated dates on the USCIS website are Aug 31. I have not gotten the biometric appointment date yet.

Is there any way that we could get more info on our case? any pointers would be of great help.

Aug23 : Checks cashed and Received NOAs that the application was accepted on Aug 17th

Sep 23 : USCIS updated their site saying that they mailed a notice for my I 485 and EAD.I called then and found that there was a typo in the address(USCIS mistake.They resent the mail immediately)

Sep 25 : Got the notice that the USCIS re mailed.It was Biometric appointment letter. Appointment date OCT 8.

Sep 29 : Got email from USCIS that my AP is approved.

Sep 30 : AP touched

Sep 30 : Biometrics walkin. (Finished biometrics in < 5 minutes) @ ASC Charcot ave San Jose,CA

Sep 30 : EAD card production ordered.

Oct 1 : AOS touched

Oct 1 : EAD touched

Oct 3 : Received a appointment notice for biometrics again for the second time.

Oct 5 : EAD touched.(got a second email for card production) also I called the USCIS and informed them tha I have not received my AP approval notice yet.It was mailed to me on 29th Sep.

Oct 6 : Received email "EAD approval notice mailed to you"

Oct 7 : EAD touched.

Oct 8 : Went to the ASC san jose to check on my second biometrics appointment letter.They said that it was just a system error and that there is nothing that I need to do.

Oct 9 : Received the EAD card in mail

Since its been like 30days since you haven't heard anything, call USCIS and tell them that you haven't received your biometrics and it's been 30days and they'll usually get right on it :)

On Saturday I received a hardcopy letter stating that my AOS case was transferred to the CSC. I called the 1-800 number today, and told them I had not received a biometrics appointment notification, they said that they had not sent one! That my case was in normal process in the CSC. That in case that my biometrics were needed to be taken again (my biometrics were taken in the Consulate the day of the interview for the K1 visa) they would send me a biometrics appointment notification. At least I know now that they haven't sent me an appointment. I also mentioned that my EAD and AP cases were unavailable in the website. They said they were going to process a service request for the cases to be available within 10 days in the website.

I guess I just have to wait...

You mean that if they transfer your case to the CSC they don't even call you for biometrics?

From what I've read from VJ applicants that their AOS cases were transferred to the CSC: The usual procedure is to get biometrics completed, and after that they got their AOS cases transferred to the CSC. My case was different. When I called, they mentioned that it was possible that later on they send me a biometrics appointment notification. I think each case is different and I guess it depends on many factors...

ok, I was just wondering because USCIS received my AOS package 20+ days ago and I still haven't received the bio appointment letter. I don't feel like calling yet because the few times I did in the past I had the impression that I was wasting my time.

I became aware that my case was transferred, 27 days after the USCIS received my package. Actually the first day that my AOS case was available in the website it mentioned that. Good luck! Like some VJ'ers posted, I am not sure if getting a case transferred to the CSC is good or bad news.

Hi,

I received my transfer notice before my biometrics appointment too. Sometimes it happens, maybe your ASC is too busy. I never heard of an AOS going through without biometrics so it's not just posible it is sure you will get an appointment letter
