Tanya,

Congrats on your marriage!

We bought a puppy to keep Carol company while I am at work. Also, she chats online with family and friends to occupy her time.

Try to find a chat room either here on Visa Journey or some where else that has the same interests as you.

Good luck with your AOS process.

Thank you Mark!

Yes most of the time that my husband is away, I chat with my friends and family online. The idea of a puppy crossed our minds but too bad we are not allowed to have puppies as we are staying in an apartment. I also keep myself busy by cooking good food for him, but he is gaining weight! LOL!

Just one bit of advice for those who are about to file their AOS. I had my full medical back in the Philippines but I had to get a TD shot here to complete my vaccinations. It was a challenge finding a civil surgeon who will do the shot and just fill in the vaccinations part of the I-693 as most of them insist that I should have a full medical again. Some of them are not aware that medical exams done outside the US are valid within one year but some just want to make more money from you. Finally we were able to find a Portugese civil surgeon in Newark, NJ. The receptionist at first insisted on the full medical, good thing I printed out the instruction pages of the I-693. She said that I should just tell the doctor about it coz she never encountered such case as mine. The doctor was very nice and he knew exactly what to do, without any hesitations. We only paid $61 for the shot and medical transcriptions compared to a full medical that can cost more than $200. Hope this info helps.

Goodluck to everyone and best wishes!

Tanya

Hey guys... Still trailing behind, but hope to be here soon talking about Missuzu's AOS.

If you hadn't heard, we finally got our NOA 2... 7 months after the NOA 1 (and that is without an RFE!) Then the file flew through the NVC and the US consulate in Rio de Janeiro... Missuzu's interview is set for October 19.

Hope to see y'all soon in here.

Dec. 28, 2009... NOA 1

Dec. 31, 2009... Touched

May 12, 2010... Nice guy at the USCIS mercifully sent a Service Request to the VSC to inquire about our petition

May 27, 2010... Received an e-mail stating that the VSC received the Service Request. Unfortunately, the e-mail also states that the processing time for service requests is 3 MONTHS!!

June 28, 2010... Heard from my senator that the USCIS is going to send me a RFE on July 1 asking for a certified copy of my birth certificate. Why do they have to wait until July 1 to ask for this??

July 13, 2010... Received an e-mail from the VSC explaining the delay in processing our petition. Apparently, the USCIS had put on hold all petitions from US citizens born with Puerto Rican birth certificates (like me). On July 1, USCIS headquarters finally gave clearance for these petitions to be processed.

July 26, 2010... Touch

July 27, 2010... Received text message and e-mail stating that our petition was approved on July 26!! We finally received our NOA 2!!

July 31, 2010... NVC received our approved petition

August 2, 2010... Received paper copy of our NOA2

August 4, 2010... Received letter from NVC confirming receipt of our approved petition

August 13, 2010... US embassy in Brazil received the approved petition

August 23, 2010... Missuzu received Packet 3/4

October 19, 2010... Interview... VISA APPROVED!!!

November 4, 2010... Missuzu received her passport with visa

December 27, 2010... POE... Houston, Texas

December 28, 2010... We got married!

Hey Guys and Gals,

I feel like taking a big breath after all of the plans from the wedding, but I guess we need to get the AOS done soon. I am assuming a few things so let me ask. Allie's entry date was at the end of June. We need to file AOS before the 90 days is up for the K-1. Correct?

And the fee is $1010 and $600 for our son who is 5, correct? Total of $1610.

Good to see the Rumrunner is still afloat. It has been an amazing trip and I look forward to the day when Allie and I no longer have to worry about the next government form that we have to fill out.... I'm sure everyone feels the same.

Steve,

You don't have to file before 90 days, but your fiance's legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. Many people have filed after 90 days without any problems, but try to file beforehand if possible. I don't know how the USCIS expects us to plan for the wedding so family members can attend, obtain enough physical evidence as proof of relationship living in the same household, and file for AOS within 90 days. I'm going to do my best to file within the 90 days, but I'm not sure if I'll make it.

Congrats on your wedding and good luck with filing AOS.

Mark,

You don't need to include any evidence with your AOS packet. They don't really expect K-1 holders to provide any, given the short time window between POE-AOS.

---

Update:

Got a second biometrics appointment letter. First time we went in - the fingerprints weren't good enough for the FBI, apparently.

At least Daria's A# is correct on this notice... but now it's missing a receipt number.... just can't catch a break with these guys.

We are going to try a walk-in tomorrow morning. I am 50/50 on them rejecting the fingerprints again.

Also, for some reason, both EAD and AOS were touched 8/30, 10 days after biometrics... wonder ####### they are doing.

In any case, keep this thread going.

Cap't,

Thanks for the info. I was under the impression that for the AOS, you needed to show that both of you lived in the same household. Providing bank accounts, utility bills, credit cards with both names on the account with your home address. After researching the AOS info on VJ, I can't find any mention requiring this evidence...that makes it alot easier to file.

Good luck with your second biometrics appointment.

Hey Guys,

Nice to see a thread for the dec filers! :)

Just to chip in, I didnot visit a civil surgeon in the US at all to file for my AOS. I just sent a copy of the medical records that were obtained as a part of the K1 process. There has been some discussion on this on visajourney. I just figured if i needed to do anything more i'd get an RFE and since I would get my AP and EAD independent of it, an RFE wouldn't affect me all that much. I guess there is nothing wrong in getting it out of the way, I was just lazy :P i also read that ppl have been approved with just the k1 meds.

Well, my AP and EAD are approved and I will let you guys know about the green card.

Sowmya

Sowmya,

You are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Only if your DS-3025 is marked "incomplete" is a I-693 required to be completed. If it is marked as such (incomplete) you are required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope).

On another note: If you are required to attend an interview, one of the most critical items requested will be "evidence of the relationship" which proves that your marriage is true and faithful (i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any, etc.).

You can find this info in the step-by-step guide on how to file for AOS for K1 and K3 visa holders.

Good luck with your AOS process.
