I and my US fiancee are getting married next week. I entered the US on a K1 visa in May and my I-94 expires on August 14. Although we will marry before the 90 days expire, we won't be able to file for AOS immediately because it takes at least 2 weeks for the County office to record the marriage and issue a marriage certificate.

On August 10 I and my wife will have to travel by plane within the US because she has a job interview, and after that we would like to rent a car and drive around for about 10 days, having our low cost honeymoon. After this, we will return the car and take another flight back home.

My problem is that on August 15 I will be out of status, although we did comply with the 90-day requirement.

I was thinking to make a copy of the marriage license signed by the officiant and our witnesses, this would be the only evidence to prove that we got married.

In your experience, do you guys think it's safe/wise to do so, or is it too much a risk to travel at least until I receive my AOS NOA1?

I am sure that as long as you travel within the US there is no problem at all. Sure, take your marriage certificate with you, but you will be just fine. There are plenty of people applying for AOS after the I-94 expires and they're fine, but make sure you apply for SSN before you go on your honeymoon. Congrats for your upcoming wedding and have a great time!

I am sure that as long as you travel within the US there is no problem at all. Sure, take your marriage certificate with you, but you will be just fine. Thank you for your reply. I already have a SSN because I applied for it right after arriving here. It is a restricted one (valid for work only with DHS authorization) but obviously I will fix this only once I receive my green card.

Travel within the US is fine. Make sure you take a copy of your marriage certificate though just in case.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to " Working & Traveling During US Immigration" as this is relating to travelling BEFORE AOS**
