Need Suggestion !!!

Hi All,

Just need small suggestion for my cousin. Married Son in Canada and his parents are LPR and Sister is USC. Parents just recently got LPR so we understand that parents can not file I130 right now for married son unitll they will be turn to USC. If sister is filing I130 for married brother its a long wait time too. What you guys will suggest ?Should he wait for parents citizenship or sister can file I130 now?. Which way is better. Please suggest. Thanks.

If I am not mistaken, one of the Parents must become a USC before they can file for a married son. The time for them to become an USC could be 3 to 5 years. On the other hand the sister is already a USC so she can file immediately. So it's not so much as to which way is better but which way is faster. In my opinion having the sister file will result in a faster immigration. But all in all either way the wait time will still be a bit long.

I would do both- have the sister file now and then when the parents become USC, they file too, unless the case is already at interview stage. This way, the two petitions can race it out and the brother is covered.

Thank for your response Penguin_ie. So if USC parents will file I-130 i think its gonna be 10 or 12 more years for married son. How about sister if she file I130 now how long its gonna be aprox.

As of right now, the waiting period is 9 years for USC sister petitioning Canadian brother, and 8.5 years for USC parents petitioning married son from Canada. So it is likely that with the waiting for parents to become USC, the sister's petition will get approved first, but you never know how things can change.
