AOS after an overstay on a VWP

Came to the usa same way you did,my vw expired long time ago,married my wife(us citizen)

we sent all paperwork got my interview today august 18th 2010 we got I-130 approved but

I-485 its pending cause i came on visa waiver program and they are trying to change the laws in washington

my thoughts to you, do it now before they change the law. you should've done it way before.

the immigration officer told us that 3 months ago i would've been approved but now my green card is pending i will

recive my work permit and ssn in the mail.

07/08/2010-----biometrics done

08/19/2010-----interview-I-130 approved I-485 pending.

Get into the system now. Don't wait until they pass a law barring all overstayed VWP entrants from adjusting status. The worst thing you can do is wait at this point in my opinion. The laws are getting tougher, not more lenient. The country is become more and more conservative and immigrants are big targets. You have a good chance of being accepted, with a baby and all. Worse come to worst you go home for a while and apply from there. It would be hard, yes, but nothing is worse than the life of a prisoner you have now. I know what your are going through. I have not been able to work or live as a full fledged resident for a year and a half. I can't wait for my interview just so I know either way where my life is headed. Good Luck.
