Questions regarding Waiver process in UK

Okay trying to find out some details here. My fiance will more than likely require a I-601 as she has a previous overstay of 7 years.

We have already drafted my letter of hardship, filled out the I-601 and gathered the supporting documentation. She will be having her interview at the London Embassy. But I do have a couple of questions.

We know that we can submit the I-601 at her interview, but the question is do they keep her passport at that time? If not how does she return it to the Embassy when and if her waiver is approved?

Is there anyone else that has had an overstay of that length? If so did they get a waiver granted?

She left on her own, no involvement by government or anything, she just bought ticket and went home.

hi dwar49

Yes london doesn't keep the passport. They will mail you a letter to inform you if your waiver is approved. They will instruct you on what carrier to use to send the passport back. It usually takes 10 days to 2 weeks i think.

Once you get your waiver filed it takes about 2 - 4 weeks for them to put you on the online waiver list. You can track your case once it is on there. http://www.usembassy.org.uk/dhs/uscis/ivwaiver.html

We have had a few people with overstays but I'm not sure how long they were. Here is our little list we had going on another thread. (page 3 on here)
