But WHY are you shocked? You were not divorced until this month, and yet you filed for a K1 Visa back in December. It doesn't matter how legitimate your relationship is at that point if you are still legally married with a divorce pending.

What I am not understanding is that from what I've read here, it is normal for people to forget to send their final divorce decree and get an RFE during the I-129 part, asking for it. And yet they let this couple go ahead for the interview fase...

05.30.2012 -- Biometric notice issued

06.06.2012 -- Biometrics Date (walk-in). Was scheduled for 06/14

xx.xx.2012 -- 10 Year Green Card Received

That's what was confusing me too, but it looks like y2catalyst was in fact divorced in 2009. So the Visa was denied because there was not enough evidence of a relationship, it sounds like.

Hey guys - just a quick check in.

You need to recognize that Guangzhou Immigration Visa Unit is one of the hardest in the world, is a high-fraud country - so the criteria utilized is much harsher than most other places.

Also, 'reporting back' to the Interviewee on 'exactly why we are issuing you a denial' is never done - usually, the most a person gets is 'not a bonafide relationship' and that's that. Filing a FOIA request takes months to get back, and rarely can see actual case notes on the casefile for interview day.

Even with that said - cut y2Catalyst some slack - as he's just had the biggest emotional bomb in his life. Seriously. Cut the man some slack. In a few days, or weeks, he'll be calm enough to be focused on the 'next thing to do' - but for now -

Cut him some slack - he just got a 'white slip' at one of the toughest MF'ing IV units in the world.

Seriously.

I am tired of being told to cut him some slack. You can, if you'd like. That's your choice. How others react is their choice. Nobody, not a single person, is undermining what he's been through. We all empathise. However, I have no respect for people who just play the race card when things get tough and don't go their way. Nor do I have respect for people who feel the need to brag about how successful they are and how much money they make, and act like that somehow entitles them to have things handed to them without working for it.

I am all in favour of blowing off steam and venting to a group of people who will understand my situation. However, I'm not in favour of going about it in an insulting, condescending way.

React however you'd like, but let others do the same.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Visit once, October 2009. I will go back end of the month to visit again and try to file K1 again but my lawyer said if I go at the end of the month just marry her then. So we will try again either way.

Looked at his computer 5 minutes and issued white slip

All phone, travel, records, EOR letter, engagement ring, money trandfers and forms complete and verified by Lawyer but were never asked for even though she tried to present them.

April 2009 meet on internet

Oct 2009 two weeks in Chongqing and were engaged, showed her ring

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

Sorry to say, that K-1 is 'done' for now. You know what to do, though - and you've got a plan.

IMO, the CR-1 will have more weight to it - but do plan for 2 more trips after marriage.

I was gonna say the same thing. Not much there. At least when I got 221g, they specified why. I fixed the issues, went in a week later and she got the visa.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

I think you need at least 3 visits 6 months apart. while there takes tons of photos with you, her and family all together at different places, beach, restaurant, hotel.

I think this is the reason. take pics of engagment rings, reciepts.
