NOA2 Approvals on IR1/CR1's

Hi all,

I'm starting to notice - after seeing hundreds of IR1/CR1 timelines - that, although there is supposed to be a system of "first-come, first-serve" adjudications by the USCIS (that's why the priority date is so important, so you know where in the queue you are, right?), there are some I-130's and even some I-129F's that I see that receive their NOA2's in an abnormally short amount of time - i.e. 6 weeks or 8 weeks after the NOA1's!!!!

Does anyone have any explanation for this?

One wonders what the heck is going on!

CR-1 VISA

Not for I-130's for CR-1/IR-1's filed to the lockbox in Chicago -

they're trending at 4 months, currently.

Anything you see less than that? check the profile of the user - it's a DCF'd case.

My best guess for the I-129F's is that Lewisville is taking a lot of casefiles currently. But it's only a guess.

They may pick up 2 applications on the same day and look at the basics. Then they start the checklists and depending on your history that is where things get harder. John Smith may take longer at name checks than Izekel Hjekle ( more apt to get a fake hit ) If you have previous applications you may slow up, if you have had a government clearance you probably pass right though. Are there divorce papers to check, are there any hits for unfiled taxes. Then once they finish with the USC they start checking out the foreign national. Same thing happens. Some countries have better record ( UK ) and some are terrible ( Nigeria) Second petitions usually go faster than first ones ( for the same person)

This will not be over quickly. You will not enjoy this.

USCIS looks at tax history? for some reason i thought that they only looked at that stuff at NVC in reference to the I-864, still i thought they just looked at it to see that the affidavit of support met it's criteria. How do i learn more about that? would un-filed taxes cause red flags?

EDIT: that the patitioner met the affidavit of support criteria

Let's talk only about CSC cases.........

I have seen so many cases that they are getting approved in an unorderly fashion. A person who's NOA-1 date is 30th march is getting approved first than the 13th or 15th march NOA dates. (just an example). Like this example you can find so many uncertainity ... I mean what's the reason for this ...

If they received my application on 9th .... than I should get NOA date of 9th april. My priority date should be 9th and not 16th. This is ridiculous ..... Even when I add 800 numbers to my receipt no. - and check the status of each.....they have NOA date of 15th march....than why mine is 16th.........IS THERE ANY DIFINITE ANSWER ? USCIS sucks........SUCKS SUCKS. :angry::wacko::devil::luv::(:o:ot:

ok...just please clarify...you said that "if you have previous applications, you may slow up" but you also say that "second petitions usually go faster than the first ones". What "previous applications" are you referring to?

Hi Darnell, thanks for your response....it makes a lot of sense. However, the inconsistencies in timelines that I see are not DCF's - at least they don't appear to be. Take the below timeline for example (click on the link) - it took less than 2 months to get an NOA2 from the NOA1!! And from Nigeria no less! If there is no explanation, then so be it. And if that's the case, then the priority dates should not be etched in stone and people just have to hope that their case is "sooner rather than later".

That was last year, for CSC. CSC had a 'spurt' last year, whipping I-130's in and out in record fashion - anywhere from 31 to 55 days. That 'spurt' is gone, alas.

Also, to note - anyone you see with an approval in JULY 2010, that wasn't DCF'd, less than 70 days, was some form of EXPEDITE .

Hi S. How do you know this? Can you refer me to any documentation that you know of or is this conclusion from your own observation? Because when I first filed my I-130 petition on June 9th, I actually called the USCIS to see if there was some kind of expedite consideration for me since this was my second petition for the same person (as u know, our first petition for the K1 visa was denied at the Lagos Consulate). They told me that 'no' it doesn't work that way. That's why I'm asking you how you know this? (Knowledge is Power)

USCIS doesn't have a official first come, first serve policy. Each case is unique. Some cases are completed quickly. Some take longer due to a host of reasons. You can imagine why a casefile from UK would take less time than would a casefile from Yemen. Just one example.

So really, not every petition application would go into the same queue, correct? Because if it did, you'd still have to wait the same time (i.e. 4 months) to reach both petitions and THEN the UK one might move faster than the Yemen one. I don't think we have the full picture. It's really a lot of logical conjecture on our parts. What would be the point of priority dates than?

USCIS doesn't have priority dates. It's the NVC that has priority dates. Oh and I don't feel like arguing about this anymore.

I was following through this thread. Nobody knows what is happening inside the USCIS (At least I do NOT know :-)). All the comments here are logical thinking and assumptions without the concrete factor.

Only thing I know (another logical thinking!) is - there are many USCIS officers in one building. They are like machines. Chicago lockbox dumps the enevelopes (some sent by express mail, others priority mail etc.) to these machines. Some machines are so slow because of age factor, dull factor (whether they had fight with their spouse etc.) etc. compared to some fast machines. Do you need solution how to improve the speed of this slow machines? One is to provide them commission based income - more package processing more commission :-) Another external delays also exist such as background name check etc. No idea whether these packets are added at the end of the queue or in the queue that are processed based on priority date or was it added to the slower/faster machines' queue. My imagination grows at this point of time :-) But, before that let me get some responses from you :-)
