Timeline

Yes, there is. It comes in the intructions. If you fail to return it within the period of time stated in the RFE, you're abandoning the case.

May 1, 2006 - Submitted I-129F (Overnight) NSC

May 2, 2006 - NOA1

June 1, 2006 - Transferred to CSC

June 14, 2006 - Notice from CSC it was transferred

June 30, 2006 - Received IMBRA RFE (CSC)

July 5, 2006 - Touched (RFE Received)

July 31, 2006 - APPROVED

August 5, 2006 Physical NOA2

August 15, 2006 NVC Received and Sent

August 22, 2006 AIT sent Packet 3

August 22, 2006 Packet 3 got lost in the mail... sending another.. :( :( :(

October 27, 2006 Interview

I just checked mine - it has a notice date of June 26, and says return all infor requested by Sep 18. 84 days I believe. Why 84 - who knows which hat they pulled this policy out of? It looks like it may vary from person to person. :unsure:

2/28/06 - K-1 app sent to NSC

3/06/06 - NOA 1

3/31/06 - NOA 2

4/12/06 - NVC sent approved petition to Paris embassy

4/24/06 - fiance received instruction pkt (pkt 3)

5/05/06 - pkt 3 checklist returned to embassy

6/16/06 - CRIS-USCIS email "petition received"

6/21/06 - 1-797s (2) received, petition "received", "reopened" by CSC

6/26/06 - email, RFE sent

7/05/06 - RFE received and sent back to CSC

7/06/06 - RFE received, signed for by receptionist at CSC

7/11/06 - email RFE received by CSC

7/12/06 - touched (same message as day before about RFE receipt

WAITING WAITING WAITING

8/15/06 - NVC receives reaffirmed petition (no written confirmation yet)

8/22/06 - NVC sends reapproved petition back to Paris CHOUETTE!!!!

9/21/06 - Pkt. 4 received

10/4/06 - INTERVIEW scheduled\

11-14-06 - VISA RECEIVED!!!!![/b]

12/08/06 - Arrives - POE PDX

12/14/06 - Married in Vegas, Baby!!!

AOS

01/03/07- I-485 sent to Chicago

01/09/07 - NOA from MSC

01/30/07 - Biometrics taken

02/01/07 - touched

04/10/07 - Interview scheduled/AOS approved - I-551 stamp in passport

04/18/07 - Permanent Resident Card received!!!!!

I thought the scanned RFE notice was the standard mail-out, including the date.

Umm, I'm not sure. But if you abandoned the case, then I'd guess you'd have to refile.

What if the RFE looks slightly different from the scanned copy found in this section? The other copy doesn't mention anything about filing a waiver.

Follow the instructions on *your* RFE.

IMBRA rules do apply to everyone but what one's required to do because of them differ.

From I-129f instructions:

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved

within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

If you have committed a violent offense against a person or person, USCIS may not grant such a waiver unless you can demonstrate that extraordinary circumstances exist.

IMBRA rules do apply to everyone but what one's required to do because of them differ.

From I-129f instructions:

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved

within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

Just as I thought. This is the petitioner's second K1 within a two-year period. Thus a waiver request is required. However, this particular IMBRA RFE does not state that. This is where it differs from the scanned copy available in this forum.

Can anyone confirm if a waiver is required in my case when the RFE does not mention it?

If you answer 'yes' to any of these questions, you do need a waiver:

Have you filed two or more K-1 visa petitions at any time in the past?

Have you previously had a K-1 visa petition approved within two years prior to the filing of this petition?
