I have answered YES to all 3 qualifying questions that are listed on the 864EZ. I can apply to sponsor my beneficiary on my own income alone and she is the only one on the petition.

However, as part of the 864EZ instructions (checklist) you are not allowed to show them any assets (or any liabilities). If you show assets then you must switch to the I864 form, not the EZ.

I have a rental property that I rent out to a tenant - and it still has a mortgage due on it.

The line items regarding rental income and rental expenses do show up on my Tax Transcripts.

However I was still able to answer YES to all 3 qualifying questions on the 864EZ. So that being said in my situation should I still be able to safely send in the 864EZ with just transcripts, letter of employer and maybe some pay stubs or W2s?

Since I would not be showing any assets or liabilities is this something that will come up later in the process? Perhaps during the interview?

Yes. You can send the EZ form. Also, you aren't going to be interviewed. Your beneficiary is going to be interviewed. Since the beneficiary doesn’t own the property, s/he shouldn’t be asked about that. But when it comes to immigration, people assume everything is game. Do make your spouse understand that you owe the property should they ask anyway.

IMO, it should not be a problem. In fact, I personally prefer I-864EZ (if one qualifies) which is shorter and very EZ to complete.

As long as you qualify with your salary income and can include pay stubs to support that, you do not need to include rental income on your I-864EZ. If you need your rental income to qualify for the 125%, then you will probably need to fill out the regular I-864 because you will need to show supporting proof of that income (i.e. rental agreement..etc).

I own rental properties, but my salary alone qualified me for the 125%, so I did not claim them on my I-864EZ.

My income qualifies me to use the EZ but my tax returns show a lot of expenses as well (college tuition for my kids, a high mortgage interest/taxes deduction). So I am a bit anxious about using the I-864-EZ form over the regular one.

It IS much simpler though and I would like to use it if there's no reason not to.

There is no advantage to using the I-864 over the I-864EZ, other than simplicity.
