NVC does not have my file

As of Aug 17 i still do not know where my file is. I have contacted my senator i have contacted USCIS and NVC many times infact every day. I have sent email to all NVC links as well as USCIS links. But still No clue. Me and my finance are really stressed out. In fact so much that we are now fighting everyday because of this. If anyone can help me and guide me which route should i take i will really appricate it. I dont want to refile my case but is that my only option left???

It seems like you had similar issue. Looking at your timeline it took USCIS one month to send your petition to NVC. Please share your experience with us. Who did you contact and how long did it take NVC to get back to you? NVC responded to me via email a week ago that they will contact USCIS on my behave.

10/18/10 -Called NVC and gave both beneficiary and petitioner email addresses

10/19/10 - Beneficiary emailed DS-3032 to NVC and also mailed the hard copy

10/26/10 - Called NVC and got the IIN

10/26/10 - Paid AOS fee $ 88.00

10/27/10 - AOS fee status shows "PAID"

10/27/10 - AOS package expressed mailed (next day delivery)

10/30/10 - IV fee bill generated and paid immediately

10/30/10 - Received AOS fee bill and DS-3032 kit and also received the confirmation of receipt of DS-3032

11/04/10 - IV fee bill status shown as "paid"

11/04/10 - Sent IV package (next day delivery)

11/06/10 - Received IV instructions packet (packet 3) via email

I am sorry to hear that. I know exactly what you are going through. After 40 days of waiting and calling senators, congressman, USCIS and NVC I gave up and sent duplicate copy to USCIS, as instructed in their email. I waited a week after they received my copy and called USCIS. After Immigration officer at USCIS told me they will get back to me within 90 days (what???) I called USCIS headquarters at Washington DC and demanded to talk to the supervisor. Supervisor at headquarters was very nice and understandable. She promised to find out what is going on and call me back in a few hours. A few hours later she called back and told me my original petition was found. Within 2 days it was in NVC.

I think you need to call DOS number and ask to speak with an officer and explain him the situation.

Calling DOS does not help. I called DOS many times. Officers tell you what they see on the screen. In this case someone at Service Center has to physically look for the file and if retrieve it from archives.

How and where did u get the headquarter number from. Also can you give the number and name of the supervisor I would really appricate that. Also another I still have not received any letter stating that they lost my file and should resubmit

I have this number at work. I will post it tomorrow morning.

USCIS will instruct you to send duplicate copy once immigration officer submits second inquiry to Service Center.

After first inquiry their email will simply state that USCIS sent your petition to NVC and you should contact them.

The number is (202)272-1899. I can't find supervisor's name, but you can request to talk to her. I think it's Mrs Bell. Just let operator know you have a serious problem with USCIS and no one is helping you. Let me know how it goes.

JVF, I emailed my service center about my I-130 that didn't reach to NVC after 29 days of approval. One of the officer got back to me saying "He checked the system and my case has not been sent to NVC, he has requested my file and will send it to NVC once received"

I don't understand from where he has requested my file. Shouldn't it be at Service Center?

What is archiving at USCIS, how does it work JVF?

After NOA2, within 40 days I received a few emails from NVC. Those email stated ".

"Your inquiry has been received at the National Visa Center (NVC).

Please be advised that the National Visa Center (NVC) has received your inquiry and the attached I-797 Notice of Action – Approval Notice. Unfortunately, we do not have record of receiving your approved petition. The NVC will contact U.S. Citizenship Immigration Service (USCIS), on your behalf, for information on the location of this petition. "

Personally, I don't think they contact USCIS. It's just "fu... off" email. I spoke to a few supervisors at NVC and they were surprised NVC contacts USCIS on your behave. Maybe they sent a request email to them, but at the end they receive same information you already know "we don't have it". NVC was not helpful at all on locating my petition.

One of the officer at USCIS also told me my case has not been sent to NVC. Of course not :), it's not at NVC.

Another officer told me my petition was forwarded to my local service center in New York (what???). I even made infopass appointment, but then canceled after another officer at USCIS told me this is not true.

I am not sure what the f... is going on there, but every time you talk to someone at USCIS they give you different information. Aren't they looking at the same information on their computer?

I think he send an inquiry to Service Center. Did he provide you with Referral ID?

If this service request was expedited then you should received reply from VSC.Ncscfollowup@dhs.gov within 5-10 business days, if not within 20 days.

Don't want to make things up. I am not sure how this works.

In my case, I think, whoever I spoke to at headquarters followed the paper trail of the petition and found it was put in the wrong out tray or something. You just need to find that person who will care enough to do this.

Don't give up hope. It can't hurt to write and call as many people as possible.

That is so true JVF. Different officer at USCIS see different information about the case. How can they deliver wrong information to their customers? When I called them last friday about my approved I-130, the customer service lady told me "your petition was transferred and still pending with USCIS...blah blah blah..." I interrupted and told her that's not true. My petition has been approved on july 20 of this year and you're giving me wrong information, she then told that is what my system tells me.....grrrrrrr

JVF, yesterday I went to my congressman and explained about my situation. They have assured that they will work on my case. Lets see...

Wait has never been easier. Help me god...........

"You just need to find that person who will care enough to do this."

This is the key point despite being much harder. :)

Vermont center sent out another NOA2 on Aug 18th. And today i called NVC and they said that they received the file today and will be sent to embassy within a week or so. If you had not pointed me to the right direction i do not know where i would have been right now. Finally some progress and file finally at NVC after such a long time.

Why can't people at normal USCIS hotline provide us with the same service? Why do we have to hear this 90 day BS? I am really happy you are all good now. I know exactly how you felt. God willing things should be moving a lot quicker for you now.

JVF, congrats for your interview schedule.

I am still waiting for NVC to receive my case. I have been sending emails to TSC and bugging them. They say my case has not been sent to NVC, they have requested the file and will forward it once received. I donno how long it's gonna take. :(

12/15/10 - Case Complete :)

01/03/11 - Interview date assigned for Feb 15 @ 1:30 PM

01/17/11 - Medical done ! Passed

01/25/11 - Re-scheduled the interview for Feb 1 @ 1:00 PM

02/01/11 - Interview @ 1:00 PM - Approved :)

02/03/11 - Visa picked up from USEM

02/12/11 - POE @ JFK
