Can you change from a K-1 to a DCF

My Fiance has entered the POE in the USA on a K-1 visa. She had a family emergency and had to return to the Ukraine prior to us being able to marry about 10 days after she arrived. The embassy will give her another visa to reenter the USA. But now she wants to be married in the Ukraine. Is it possible to go the DCF route at this stage and we be married in her home country. Has anyone have any information that might be helpful. Thank you in advance.

Timeline

You would have to check with the US embassy in the Ukraine to find out their requirements for DCF applications. Some countries require both applicants to be resident in the country for a period of time before accepting them for a DCF application. If you do not currently live in the Ukraine, you might have trouble qualifying for a DCF application.

Check with the embassy to find out their requirements.

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am

It looks entirely possible, but there's only one way to find out: Call them.

Suggest that you review the DCF Guide first and make your best case :) It is at the Consulate's discretion.

To avoid various issues, why not have a civil ceremony in her country. Basically everything except the legal seal being placed on your marriage and then when you arrive in the US have a legal ceremony. This is quite common in many places as the family wants security that there is a marriage, but understands government processes are often somewhat rigid in these matters.

The reason to suggest this goes back to the idea that the K-1 would enter the US and be married and it reduces the possible delay in processing and separation that could come with changing status.
