My boyfriend and i were going to do K1 visa for me.He called Marc Ellis for helping,he told my b/f that he should comeback VN 1 more time to get the stronger case because When i and my b/f were meeting ,he still in married but They've been separated almost 4 years.He just got divorced paper-work last-month.Anybody can tell me he should comeback VN again ?

About b/f :37 years old.worked for Military/Navy 9 years,but not now,he's a full time student at Uni and has part time job as well.He's using Gibill 911 which is for Veterans.And school loan.

About me:24 years old .i had a job before meeting him after that I quited it for our trip around North VIetNam ,so now i'm at home and help my family small bussiness.

I want to ask We have any troubles with our case ?

I heard K-1 is pretty hard to get approve nowadays.

He should come back to vissit after the divorce... The fact that you met and began a relationship while he was married is a red flag.. I am going through the result of not waiting some extra time after the divorce to file... The CO will want to know why you enetered into a relationship before ending one... not saying they are right.. just saying the way they see things.. Mr Ellis is telling him what to do to avoid waiting years to be together... take your time and get the relationship documented so that the CO has no problems issuing the visa...

At least wait a bit after the divorce before you have the Dam Hoi... and file...

I suggest that both you and your US fiance take some time to read through the Vietnam forum and also the CR1 forum and Guide here on Visa Journey. This will help you both to understand the process and requirements.

You will find many different expereinces for all the members. Take the advice that matches your situation along with any advice that your attorney will give. Noting is guaranteed. But if you learn from all the experiences going before you then that should help to avoid a lot of the problems.

You are filing a K1 visa right? For a fiance? In VN it is customary to have a Dinh Hon, and Dam Hoi in the engagement phase of a relationship which the consulate will be evaluating whether the relationship is valid or not. You have a red flag already that you started the relationship before he was divorced.. if you dont follow VN traditional norms you can add another.. HCMC has denied couples in the past that appeared to have had a wedding already so take caution not to create the appearance that you were married to him when filing a K1... some have had a wedding party doing a K1 but not shared that info with the CO.

This consulate looks at cases and looks for things that stand out as not normal to them.... This does not mean the relationship is not real, just that the consular officer suspects there is fraud due to deviation from some societal norms.

Here is a list of generic things that stand out to a CO at every consulate:

1. A very brief courtship followed by a plunge into matrimony;

2. A marriage ceremony arranged only a short time after petitioner arrives in the beneficiary’s country and they meet for the first time;

3. No common language;

4. Petitioner resides with family members of the beneficiary in the US;

5. Petitioner is employed by or has a business relationship with a relative of beneficiary;

6. Petitioner submits phone records that show he uses a residential phone number that is listed in the name of another person.

7. US divorce followed very quickly by an engagement to foreign beneficiary is often a red flag for consular officers.

8. There is little or no documentary evidence of the relationship prior to the actual engagement.

9. Long gaps of time between the petitioner & beneficiary being together in person.

10. Failure to disclose previous marriages;

11. Failure to disclose previous petitions filed on behalf of other beneficiaries.

Why rush? This is going to be a lifetime union so just take the time needed and do what is needed to get a satisfactory ending. This is just me but it seems from what you have said could mean that you both need to sit back and read this site and start fresh. Start documenting the relationship heavily and saving everything.

Yes thanks to all. I just think that we should go slowly and take time . :huh:

He's going to VN as soon as possible as SINGLE MAN with divorce decree in hand ,It's better :blink:

Other a question out line : The Flights're such an expensive price that to book for a trip this time :lol:
