SF office: AOS marriage interview - further review notice

My wife and I had our AOS interview in SF today. The lady was professional, very cold and had a ton of questions. The interview took what seemed like a long time. At the end she returned my I94 to me and gave us a sheet said that said our case was under further review. She said that we will receive any notices for further documentation if necessary. She didn't imply that it would be necessary but also didn't state any sort of time frame when we can expect to hear more.

Has anyone else had this happen recently? To ease my concern, I would love to hear how this sort of situation resolved for others and approximately how long it took.

I'm sorry to say this but when the I-94 is returned, it usually means bad news. Did she separate you guys during the interview? Do you have any unusual circumstances that would cause someone to doubt your marriage?

hi hoopsfan.. thanks. No, we were not separated. We have been together for 5 years and provided all sorts of joint docs like car insurance, health insurance, cell phone family account, bank accounts, etc. I guess the only unusual circumstance could be the fact that we got married in a small ceremony at home with about 10 people present. But we explained that we are going to have a reception back in India. The other point of doubt could be the fact that there is a 10 year age difference between my wife and myself. I felt that the I/O was just not skilled at weighing the evidence correctly and was being needlessly aggressive. But I guess some of them think they get paid to be a##holes.

This is probably it. Who's older, you or your wife? Also how long have you been married?

From what I've read on these boards, they will probably call you guys in for a 2nd interview (where they separate you and ask questions). As long as your answers are pretty similar, they will have approve to it eventually. Good luck!

ps: If they do call you for a 2nd interview, it might not be a bad idea to get a lawyer involved...

The small wedding would not be a big deal at all if you entered with a K1. It's practically impossible to pull off a big wedding in 90 days. I read in the USCIS reviews for the SF office that quite a few K1's had very small weddings or a civil ceremony, and it wasn't a problem. USCIS doesn't apply the same cultural standards as the consulates in foreign countries.

I agree that them returning your I-94 is not a good sign. There has to be something more than just the age difference and the small wedding.

The age difference might be a factor if one of you is 20 and the other is 30. Much less so if one of you is 45 and the other is 55. It would be a much bigger deal if one of you was 20 and the other was 60.

The 10 year age gap is nothing at all, as they see and approve 20 & 30 years age gaps everyday. Maybe she is new at her job, or saw something that needs futher review. If you provided all the evidence that you mentioned, you will get your green card soon.
