K3 will expire but wants to travel

Timeline

Hi guys,

I am on K3 Visa right now and our I-485 application is still pending. My biometrics schedule is on the 5th of Aug. The thing is, my visa will expire on the 26th of Aug and me and my husband wants to travel in FL on the 28th of Aug. My question is, what kind of document can I show to the immigration officer in case they question my status here in the US. Do I have to apply for another application just to travel? or can I just show them my I-485 (NOA1)?

I am sorry, I have no clue on what to do.

07.05.2010 - Received Biometrics Schedule (July 26)

08.05.2010 - Biometrics done! (had to re-schedule from 7/26 to 8/5)

08.13.2010 - Got my interview letter

08.20.2010 - EAD card on production

09.06.2010 - Got my EAD Card (62 days)

09.07.2010 - Applied for SSN

09.14.2010 - SSN Card received

09.16.2010 - Interview schedule (APPROVED)

09.20.2010 - Welcome Notice Received ("Welcome to the USA")

09.25.2010 - 10 yr Green Card received! (98 days)

A visa is the permission to visit the US of A. Just like Disneyland, once you are in, you are in for the rest of your visit unless you misbehave and they kick you out. Thus, you visa means nothing anymore at this time. The I-94 in your passport took that honor when you arrived.

You do not need a visa to travel to Florida and no I-94 either. You need some form of identification if you travel by air, and that's your passport I assume. Your status is AOS pending and the NOA1 you have is proof of your legal presence in the US. You do not go through immigration on an inland flight, however.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . So, do you think that in case they question my status, showing my AOS NOA1 is sufficient enough to prove them that I can legally stay here? Yes, you are right. My passport is the only identification I have as of the moment so showing it has a big possibility of them to look at my visa and that is what I am concerned of. I checked USCIS website and I read that I can extend my K3 visa by filing out form I-539 and have to pay $300 :wacko: The thing is, I think that is a bit too much if I am going to get my visa pretty soon that is why I am looking for other way (if there is) on how can I not get in trouble when I travel. You are fine. There shouldn't be any immigration officer inspecting you if you're only going to FL.

Just bring your NOA to be safe. Go have a vacation! Enjoy the USA!

Heck,,, immigration wouldn't throw you out even if you did something wrong... n Florida they might even grant you dry-feet status and citizenship,,, Just kidding... All the airline will insure is that you have a valid government issued ID... Your passport should suffice. Go have fun in Florida.

What immigration officer? and more importantly where will this immigration officer be at? Immigration officers are only at a Port of Entry. Will you be transiting a POE?

No, I will jut go to FL for a vaca. I just asked that question "just in case" they look at my visa once I showed them my passport.

U dnt need to extend ur visa anymore cuz u already applied for AOS travelling is not an issue as long as u have ur NOA 1 for AOS u r fine(";...ask ur husband to get u a state ID instead of always showing ur passport every state when u travel if u worried much("; just bring ur passport and NOA1 if u r going to travel =) have fun dnt worry about the immigration officer cuz they only asked for visa and green card at the port of entry....
