I filed the i-130 and received my NOA1 on March 18th. While waiting for an approval like everyone else and thinking it would come any day I received a REQUEST FOR MORE EVIDENCE.

I originally sent marriage license, pictures, and many many chat sessions via Yahoo, along with notorized statements from friends and family.

My wife has never been to the USA and therefor I there is no way to have a joint living place, bank accounts and assets together. I sent all I could other then resending even more pictures.

I have no idea what else to give them and want to know if anyone has ideas.

My wife has a thing for everything being red or pink. When we were to get married I bought her a 3.5 ct engagement ring that had a 2 ct pink diamond center. I also bought her dream car (Audi TT)that is waiting here for her.

Also recently I bought a 2005 Jaguar (car) that was bought to be resold (I do resell cars on the side). The car was red and made my wife excited to see it (pictures). So I choose to keep it and give to her as a surprise also. I did the paperwork as a gift with the DMV and the car is titled in her name.

The reason I am mentioning all this is would this qualitfy as evidence? Would anyone buy such gifts for a fake marriage?

This is all I can think of sending them now.

Please do not take what I am writting in a wrong way. I am stuck right now not knowing what else to send and this is all I can think of at this point since I have sent everything else to them I could. I wanted to know if anyone thinks this will help or if anyone has advice who is in same position as me with their spouse never being in USA to aquire assets, bank accounts or living together.

Don't worry ..RFE is just a word....but it means so many diff. things, it may be an evidence or it may be something that you might have missed in the form to fill out, or any document missing or they need something more as proof.

So relax wait for your copy of RFE in mail. OR if you are really anixious about it than call USCIS and ask the operator ot transfer call to immigration officer and ask them what is the RFE is all about. But I think you should get letter in mail in few days now.

Hopefully it is not a big issue and you can have the necessary items sent right away. Did you try calling them to find out what the RFE is for? Just wondering. Dont worry it will get done soon.

have you actually received the RFE yet? because if you have, it tells you exactly what they're looking for. I got an RFE last week because my G-325A was incomplete. So i just needed to complete it and send it back so they can have it before the due date they gave me.

You should call them and ask about why they did this. There must be a reason. Do not wait and ask them, this is your right to know. Do not guess and send them anything that you might think this is what they want (for example: you send them more pictures but they are asking about a divorce termination from previous marriage...etc). So they key now is in your hand, ASK THEM THE REASON WHY!!!! please keep us posted with news, Good luck

I think you are confused about what RFE means, just because it says Request for more EVIDENCE, it doesnt mean that it HAS to be Evidence of bona fide marriage..it can be some missing info or some paper you didn't include! call them now and ask! and let us know what it was! Anybody else here from March with an RFE? and if so, did they say why? I thought they were goin easier on RFEs..

Wait for the exact details of RFE by mail.
This is the proper answer. Calling USCIS's "misinformation line" will get you a runaround at best or wrong information at worst. You must read exactly what is being asked for, and provide it promptly.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You know, right - that anytime an email is sent, about an RFE notice -

that -

calling USCIS is useless, they won't tell you the CONTENTS OF THE RFE and

the exact wording of the RFE ONLY COMES IN via postal mail.

You know this, right ?

'Ask them the reason why' is not only useless, but YOU are giving the wrong advice.

ONE MUST WAIT until that postal letter arrives in the mail.

hi i think you will ask uscis what docs that they need more...we got RFE last 2 weeks for my g 325 my fiance did forget for to send it to uscis,,after a week we got our NOA2 .dont worry about rfe...i think something is missing or something you need to answer for those docs that you sent to uscis....if you receivr RFE not it means that you are failed for your petition...thats not like that! i was like you last july 4 i was crying that time after my fiance told me that we need RFE from uscis,,,now im laughing cos that really very easy...be thankful cos they asked you RFE... evrything will be okay dont worry its ok....all you have to do is to send the docs that they need asap then after a few days you wuill receive an approval for your petition hahahahah GOD BLESS... MISS PRETTY

I received the RFE in the mail today. It is not good. They are asking for proof of legit marriage and it is the information I cannot provide since my wife has never been in the USA. They are asking for joint bank accounts, assets, or living together since marriage. It is impossible to get with someone who has never been in the USA and the thing is they stated in the letter I live in USA and she lives in Ukraine. Now I have no idea what to do.

Read it, map out your plan of attack, pencil to paper, then call around - any entity that says 'no' - go in person with copy of marriage certificate.
