I just received the worst news of my life....my fiance visa was denied..

I'm not sure why yet, She cant talk to me because shes SO UPSET. :crying:

I just want to know where I need to start To rectify this miss trial of an interview!!!!

Please any one write me with any help and experiences that may help me to get a second interview..... This Past 14 months have been building up to this sap-posed wonderful moment, only to be crushed in one fair swoop....I cant fathom this denial..So sad :(

They've already returned the petitions. All you can do at this point is wait for USCIS to sort it out. The section of the Foreign Affairs Manual they cited says this: 9 FAM 41.81 N6.8 Multiple Petit

Sorry to hear that. What the previous application does with the Denial? How far did the previous application go?

IM sorry Case is suspended...they say they will send the case back to USCIS...Now What? The american interviewer said " I dont know how you could just fall in love with another man,I think you just want to go to the USA."

Sorry to hear what has happened..hmm..i didn't know and expect they would still dig up to those..I mean, that was past already, no matter what were the reasons happened before why they didn't pursue the application is not part of you and your fiancee's relationship at the moment..and partly, you said that you were aware of what happened in the past..was your fiance able to defend her answers during the interview??...hmmm..thanks for posting..I't the 1st time I've heard of a visa denied becoz of that one...hmmmm...hopefully you both can find answers and can have another interview...Don't lose hope..keep having faith..God bless!!.. :)

I agree..we really don't know how to help since we don't know the reason why that previous application was not pursued..I know it's partly personal already if ever you will share...hmmm..the worst would be if ever nefore,that man said something wrong(or informed the embassy...can they do that??..) about your fiancee why he didn't pursue their application...it's sad to know that they really closed the case before you can even find solutions..if ever you love her, then just marry her and apply for a new one..might be that one they will not question coz you two are already married...just have faith..Love will give you strength...God bless...

I mean why they deny her just because her previous application?. If her previous application was terminated/canceled, so what does it to do with your application now?.

Anyway as i read here from other members who got Denial for their K1, the option is refile it, or file K3.

Can't you send additional evidence to prove that you have a bona fide relationship? Call the Embassy and ask about what possible recourses you have left. I may not be giving you anything solid to work on but I do hope that you surpass this bump. good.gif

2-12-10: I-129F arrived at CSC

2-16-10: NOA1 issued

2-20-10: NOA1 hard copy received

4-5-10: NOA2 issued

4-9-10: NOA2 hard copy received

4-26-10: Embassy sent Toni a letter

6-9 & 11-10: Medical at SLMEC - PASSED!

7-1-10: Interview - BLUE

7-6-10: Submitted additional evidence of current sustained income (paychecks)

7-13-10: Visa Approved! (FINALLY!!!)

7-19-10: Visa Issued!

7-21-10: VISA IN HAND! (Thank God! The wait is finally over.)

8-26-10: POE: LAX

10-29-10 Wedding

AOS & EAD TIMELINE

4-1-11: AOS Package arrived at Chicago Lockbox

5-2-11: NOA issued for AOS & EAD

5-6-11: NOA hard copy received for AOS & EAD

5-6-11: Biometrics appointment letter received

5-20-11: AOS Package was transferred to CSC

5-26-11: Biometrics appointment

5-26-11: EAD approved (that was faaaaaaasst!)

10-3-11: AOS finally approved!

Even if he married her, they will still have to overcome the reasons for denial of the K-1. It sounds like they suspect her of shopping for a Greencard.

@OP:

How much proof of bone-fide relationship did she provide?

How long have you two been a couple?

How long had she been a couple with the first K-1 applicant?


Must have info for bringing your Philippine wife/fiancee's child to the US

You said you knew about the previous visa application. Did you disclose it in your petition ? Did you have a time line of your relationship that explained how you two met during / after the failed relationship ? How far did the previous application go ? Did she come to the US ? If so did she leave in the 90 days ?

This will not be over quickly. You will not enjoy this.

I think the best thing to do right now is get your local senator/congressman involved in the issue. A lawyer can not help at all in this instance because consulates don't allow lawyers in their consulates to fight the case, nor do the consulates usually give the time of day to a lawyer

HOWEVER, your local senator/congressman has access,....and the U.S. consulate is obligated to do so....
