We just got married (yesterday) and want to begin our AOS forms..the question I had was some of the forms/things they want are repeats of what we submitted for the Fiance Visa. Like my Affadvait of support & evidence..do I need to make NEW copys of my recent bank statements again, or can I use those submitted for the K1?

Another question now that we're married..should she use my surname from now on all forms or still use the surname she applied in?

I was going to try & get her a SSS card can this be done now or not until after her AOS interview. (what about state ID too? Now or after?)

I did a search on these and could'nt find any info so any input is appreciated!:)

Congratulations on your marriage.

As far as bank statements, I did not turn in new bank statements with our AOS paper work although I did turn in 3 years of tax information for 03,04,05.

Is your wife using your surname legally?

I know I was the one needing to change my name and being the US Citizen would have had to change passport, driver's license, and social security card, so being such a hassle I just kept my maiden name.

I think there is a space on the form asking for maiden name/surname...

My husband got his SSN card the first thing he came into the country taking his passport and the K-1 along.

They gave him a temporary one saying not valid without DHS authorization.

Therefore it wasn't proof he could work. Now that he has his green card he will need to get a new card.

He also got his driver's liscense in AZ using his passport and K-1 Visa.

Hope this helps,

7-3-06 GREEN CARD ARRIVES IN MAIL!!!! Done for two years!!!!!!

I am here to help, even if it's just to offer my shoulder to cry or vent on... We are all in this together.!

My answers are based on personal experience, not fact.

We are on this rollercoaster ride together holding on for dear life.

Hi & thanks very much for the reply!

She's not using my surname yet but she wants to. So does she just start using it from on or is there something we need to do to make it happen? She does'nt have any driver license/SSS or anything here so it should'nt be a hassle?

Thats good I dont have to print out another round of bank statements that was a hassle (what is'nt!) but I have all my tax forms from before.

She was going to visit some friends in Cali, and someone told us she needs a State I.D. in order to fly or leave the state, do you know anything about that my any chance? Thanks alot for your help!

I changed to my husband's last name, but I am the USC. First step was to have it changed at the local social security office -- that also takes care of the IRS -- and then second step was DMV. I also had to jump through hoops to change my name at work, and I have yet to have my name changed with all the utility commpanies, etc. Also I haven't bothered with my passport yet. Sounds like it should be relatively simple for your wife except her passport. I guess that would be handled through the Philippines embassy or perhaps a nearby consulate? (My mother is a citizen of Australia and is able to get her passport renewed at the Australian embassy in Washington DC.)

Well I filed I-134 for my husband's K-1 visa, then I-864 for his Adjustment of Status. Since there was a six month gap between the I-134 and the I-864, I obtained a new employee letter with updated information and also tax transcripts from the IRS for the past three tax years. I also threw in a few recent pay stubs. I didn't bother with bank statements since my income exceeds what is required for our household.

My husband and I traveled from Virginia to Texas and back by airplane a few months ago, and all he needed for identification was his passport. He still does not have any form of state issued ID.

My fiance just arrive in USA and i am a little confused with her SS and EAD. i read somewhere in this forum that with the passport and the 1-94 form in the passport she is already authorized to work and to get a SS number?

Apply for the social security number ASAP, they won't let you do it after the I-94 expires, so then you have to wait until after her green card arrives. (Not sure if you have to be married before applying for the SSN while her I-94 is valid, but I believe some K-1 fiancees have gotten it prior to marriage.)

About being authorized to work...from what I've read, this may technically be true until the I-94 expires, but employers will probably (or should) insist on seeing an EAD, a green card, or some immigration document verifying that your fiancee is indeed authorized to work. And even if she did get hired, her authoration to work would expire with the I-94, and she would have to stop working until she gets an EAD or green card. So best thing to do is get married, then file for AOS and EAD as soon as possible. That's if you are anxious to get her authorized to work.
