Temporary Worp Permit before filing AOS

Timeline

Due to an error on our part, it's going to be a while till we can get a certified copy of our marriage license. So now I can't send in the AOS form packet. Is it possible to still send in the form 765 ahead of time to get the ball rolling on the Temporary Work Permit? I see in the instructions for the 485 "Fees" that it's possible to have paid for the 765 fees before hand, which makes it sound like you can get authorization to work before filing the 485. Anyone have any experience with this?

03-01-2007 - Met at a bar one weekend when I was working in Sweden

Continued to keep in touch

06-12-2007 - Came to US for first visit

She's been here 4 times, I've been there three times and we've traveled together to Czech Republic, Denmark, France, Spain and Hungary

05-12-2009 - I-129F Sent

05-18-2009 - NOA-1

05-19-2009 - check cashed

08-26-2009 - NOA-2

09-13-2009 - Approval here in US, Stage 2 Packet received by fiance in Sweden

forgot exact dates but:

02-25-2010 - Interview - Passed

03-05-2010 - Visa arrived in mail

06-20-2010 - Fiance arrives from Sweden

07-23-2010 - Married in Venice, CA

09-07-2010 - Sent I-485 Packet with work permit request

10-23-2010 - Received Work Permit

11-30-2010 - Interviewed and approved for 2 year conditional Green Card

Theoretically.

I assume you came in on a K1. The problem is that the work authorisation expires the same time the K1 does, 90 days from entry.

You can only get an EAD PRIOR to applying for AOS valid for the duration of your I-94. Given the i-94 expires in 90 days from your entry, and that it takes AROUND 60 days to get it... totally not worth it... and you can get it for "free" if you file it WITH AOS or you pay $300+ for the EAD prior to AOS
