My fiance recently entered the US (K1 visa) and we are planning to get married in a few weeks....my question is that he is interested in joining the air force...can he do that or we have to wait until he gets his (AOS) permanent residency? Thanks~

In many instances the Air Force will allow a foreign national to join the military without becoming a permanent resident or citizen, and in some cases this can actually HELP with the immigration process if they are planning to apply for citizenship at some point, as they can help to shave time off the required wait for citizenship due to service to the country.

Have him talk to a recruiter, or better yet, have him talk to the CO at an ROTC program. A recruiter will tell you what you want to hear (no matter what it takes) to get you to sign up. The CO at a college ROTC program is more apt to help you without pushing you into something that isn't right for you, or telling you lies to get you to join. (My ex went through it, trust me, we heard ALL the recruiter lies!)

Good luck, and congratulations on your wedding!!

Under what program can a foreign national who is NOT an LPR join the Air Force? I'm only aware of the MAVNI program which was started last year. There are a very small number of openings (1000), nearly 90% of the openings are allocated for the Army, and there are specific requirements. The foreign national must have skills and/or training in a field having a severe personnel shortage, like doctors, nurses, or foreign language experts. They also must have resided legally in the US for two years, with an absence of no more than 90 days.

Unless they are specifically eligible for recruitment under the MAVNI program, someone who entered with a K1 visa and who has not obtained employment authorization would not be allowed to work in the US, and they would generally not be eligible to enlist in the military until they become a permanent resident.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

As far as being a PR I think it is almost a requirement to join the military these days. My spouse has sort of looked into it as you can obtain citizenship very quickly and also some useful job skills. A recruiter is the best source of information in this but speak to several, some of them really don't know what they are talking about (one told him he had to be a citizen to join the military....lol).

Did a little looking at military.com, you can probably find more.

http://www.military.com/Recruiting/Content/0,13898,rec_step02_eligibility,,00.html

From this it looks like if you're a legal resident, you can enlist.

http://www.military.com/benefits/legal-matters/streamlined-citizenship-for-servicemembers-and-veterans

From this, there are some good benefits the military enables you to take advantage of to becoms a USC.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
