I know that to Sponsor my spouse I have to have at least 3 years of work which I don't have. I recently arrived from living abroad, so I am looking for a job,but I think I will have to ask my mom to be a cosponsor when I start the process. Her income is not THAT high, but I have no other option.

What I would like to know is if there is a big chance we will be approved even in this case (low income sponsors)?

Basically that is my main concern because I know it is required to have that AFFIDAVIT OF SUPPORT.

Also, will my son having medicaid affect us getting my husband a spouse visa?

Your beneficiary and you (and your relatives in the same address, here your mom) can include all of your assets if any. But make sure the total asset is at least 5 times of the difference between the 125% povertyline and your current yearly income.

your spouse will be denied unless you meet the poverty guidelines. if you cannot meet the povertly guidelines, even with your mom as a joint sponsor, then you will have to wait until you do.

or get yourself a second joint sponsor, you can have up to 2 joint sponsors.

Addition- But if you are a US citizen, it can be 3 times instead of 5 times.

Simple Example for a USC:-

If you, your spouse and child are the total household size, the total is 3.

125% poverty line is $22,887 for the year 2009.

Your income in I-864 is $10,000

Net Assets to qualify = ($22,887-$10,000) * 3 = $38,661

Net asset means current market value (appraisal neeed) less any mortgages and it cannot include automobiles and all.

My stepfather does not make an income tax, so where can I get the forms that have all his yearly and retirement pensions?

Do I send a letter explaining why I have not worked the past 3 years?

If my sibling is going to be away in college, do I still include her in the household?

My stepfather does not make an income tax, so where can I get the forms that have all his yearly and retirement pensions? --> Pension normally will be in 1099 form that will be sent to him in the beginning of the year. 401(k) will be in 1099-R etc. I don't know the requirement of NVC that he needs to file his tax returns in this case. However, he has to file tax return with IRS if he owe or not.

Do I send a letter explaining why I have not worked the past 3 years? --> It is good, but still you need to prove you have enough financial resource to support the intending immigrant

If my sibling is going to be away in college, do I still include her in the household? --> Yes, if she was your dependent and you included her in your tax return. Also, if you combine your mom's income, you have to include her as well.
