Has anyone out there ever gotten the I-130 process done faster by contacting their Senator? This is the second filing for us the first one was approved but Guangzhou refused her on the grounds 'not a bonified relationship'. We have been married for two and a half years now. It may be a stupid question to some of you but I was raised that the only stupid question is the one not asked.

Oh man........that was really frustrating......Well contacting congressman ... to me I don't think that would speed up the process.........infact in this situation you can request an expediate based on expediate requirement grounds....if you meet any .. such as humanitarian situation, money loss, and so on....someone plz post that link...here from USCIS.

What documents did you send with your first application to prove your on going marital union ?

I would like to know as well there is any method to speed up I-130 for second time for the same person.

My wife had the CR1 GC, was in the U.S. Retuned back home due to emergency (She wanted to write UGC, University Grants Commission and do Ph.D in India. I don't think it is true emergency!) and later abandoned the GC. Now she wants to immigrate again and I have filed a second I-130 (entirely new process) for her recently. Is there any way to speed up this second one?

In G325A, I even entered her previous A# as part of I-130 application. Will this be bad or good?

As they ask to enter any A# ... yes it's correct and good that you entered.......since you should according to the form as they ask for it. But why did you let her go back to india, if you think it's not an emergency and let her GC go. OR may be that was previously ? Just curious to know, do not want to get in ...deeply.....

FWIW, that 2nd filing at USCIS should 'go faster' as the namechecks are already done, so should reduce some lag time for 'waiting on the namechecks' as the 2nd namecheck is really fast. See http://www.usaimmigrationattorney.com/SecurityNameChecksAndAdministrativeReview.html

GUZ IV is hard, yes?

Big thing for the I-130 is to 'prove up' that bonafide relationship on initial submittal, commonly referred to as 'front-loading', these days. Here's what I did, ages past - http://www.visajourney.com/forums/index.php?showtopic=218775&st=0&p=3324240&hl=Rusticentry3324240 - the concept there is that IF USCIS approved the petition, then anything put there in the 'evidence' can't be used against ya, and this evidence travels with the casefile, from USCIS to NVC TO GUZ IV, and a VO at GUZ IV can review it all PRIOR to interview day.

re: speed at USCIS - sorry, nope - if it's less than 6 months already, you've no hope in getting any speed. Longer than that, and you'll might want to think about contacting the Immigration Liason Staffer person at yer US REP or US Senators offices. You'll most likely get some speed as this is the 2nd filing for you, though.

re: speed at NVC - NOW you've got some good news, there, as NVC has OPT IN program for GUANGZHOU, can file all NVC stuff electronically via email to NVC - see http://www.visajourney.com/wiki/index.php/NVC_Electronic_Processing The cool thing, IMO, is that once yer finished up at NVC, you get an 'appointment date set' within 7 days, instead of having to wait another 4 months for the documents to clear outta Chinese Customs.

re: Not a Bonafide Relationship - GUZ IV dings ppl all the time, on the ability to communicate between the two. Is not concept of 'volume of emails' or 'we chat every day' - but LANGUAGE ability - you speak some chinese, she speaks some english, translators used, etc etc - and THIS CAN BE COVERED in a paragraph in an Evolution of Relationship Letter - see my example at http://www.visajourney.com/forums/index.php?showtopic=260331&view=findpost&p=3995116 - DJWalker slipped his in with the DS-230 EP submittal, but NORMALLY this is submitted with the I-130 and again on Interview Day. The EOR and Relationship Evidence Pile are both 'living documents' - they GROW OVER TIME. The latest, final version of both is the one you submit (in her hands) for Interview Day.

The cool thing that I see, on yer casefile, is that she'll get an IR-1 visa, a 10 year greencard, after interview day - so that's a good thing, yes? No more mucking about once she's stateside, for 10 years.

I cried a lot when she surrendered her GC. Asked her many times, please don't do it. And advised her GC is not something that you can buy from a store. She decided everything and I was completely helpless.

Now she understood when her B2 (visitor) visa was rejected as "potential immigrant". Also, she started yelling that she misses her family life with me (I wouldn't yell, but will keep my love to her inside my mind). Ok sure, I am ready to file your GC again and did it last week.

My best friend always jokes about me that I should open another expense head - "Immigration donation" :-)

Wow....man I am sorry!!! I can understand your frustration......but why didn't you file for an advance parole/ re-entry permit ? ? ?

She told me she wouldn't come back to the U.S for couple of years. When I checked the re-entry permit, it will give a max. of 2 years.

The reason for GC abandonment was - it was CR1 initially since our marriage was less than 2 years. She didn't even want to remove the condition as well. So, when CR1 expires without the renewal, USCIS will start deportation procedure, and it will be NEGATIVE in her file. So, we decided to let the USCIS know it and surrendered it in the Consulate in India with the form I-407.

To be very frank, her mind set is very changing. This is the problem when the kid is pampered so much by the parents from the childhood and born with the silver spoon in the mouth. They never know the real world complications and will regret later.

Since we recently blessed with a baby girl (she was born in India this year and I transmitted my USC to the child. Now the child has U.S Consular birth certificate, U.S passport and SSN is in progress. Indian visa (OCI) is also in progress), my wife's hormone level decreased a lot :-)
