Hi,

In the instructions for the I-131 it says:

"You may apply if Form I-485 is pending, and you seek to travel abroad for emergent personal or bona fide business reasons"

I have a pending I-485, and we wish to travel back home so my parents can finally meet my wife and to celebrate christmas with them. Is this not enough of a reason to apply for advance parole? What're the cases where you can get a I-131?

Also, I've filed a I-130, I-485 and I-765 concurrently at the Chicago lockbox. The online E-filing of I-131 asks for where my I-485 is pending - how can I find out? Is it the "National Benefits Center" or the "Chicaco IL Field Office"? EDIT: I notice that my biometrics appointment say "Service Center: MSC" and the case IDs are MSC-<number>. Does that mean National Benefits Center?

07/12/2010: USCIS sent NOA1 (FedEx receipt 07/09/2010)

07/27/2010: Did walk-in biometrics in Fresno, CA (Scheduled appointment was 08/14/2010 in San Marcos, CA)

07/27/2010: Requested expedited processing of I-765 due to financial hardship

07/27/2010: RFE (I-864 instead of I-864EZ) - expedited processing cancelled.

08/09/2010: I-131 delivered to USCIS (according to USPS)

08/13/2010: RFE response NAO received per e-mail. (USPS receipt 08/11/2010)

08/16/2010: Requested expedited processing again.

08/24/2010: Contacted Representative about help. Inquired to USCIS, told us they couldn't ask for any kind of preferred processing, and gave us status update (At the "judicial stage of the process"?)

08/25/2010: Work permit card production ordered!

If you've already filed your AOS, I think you will probably have the green card before christmas time.

Most cases currently take around 3 months to get approved. Of course it can be longer.. so doesn't hurt to file for AP

As far as I know travelling to visit family is a good enough reason.

Lots of people file AOS and apply for the AP too just in case they need it.

I don't think they are too picky about why you need the AP.

MSC is short for Missouri Service Center, which is the same as National Benefit Center :)

AP fee should be waived if you are an AOS filer.

From USCIS.gov:

"If you file the Form I-131 based on a pending or concurrently filed Form I-485, you do not need to pay the separate Form I-131 filing fee"

ALSO:

"Who is Not Eligible to e-File This Form:

You are not eligible to electronically file this form if:

You have a pending I-485, Application to Register Permanent Residence Status or Adjust Status currently at a USCIS office and you are eligible to file the I-131 for no additional fee."

Looks like you can't e-file it.

AP processing can take anywhere from 2-3 months. It can take almost as long as the green card itself. :bonk:

Oh and yeah, AOS usually takes around 3 months

There are 'freak' cases that take longer of course.

If you look at my timeline in my signature, I sent out all my forms on May 8th, and have my interview this monday.

Barring any horrible circumstances, I should be approved that same day July 26th.

My timeline is neither fast nor slow. About average.. And that's with an RFE too!

From other's timelines, it usually takes another 10 days to 2 weeks to receive the actual green card in the mail after that.

Many cultures celebrate Christmas in July! For example . . . uhhh . . . . uhhh . . . . uhhh . . . . can't think of any right now.

You do not want to use AP if you overstayed, as CBP would not let you back into the US. CBP does not care that USCIS gave you an AP document.

Other than that, you should have your Green Card long before Christmas.
