However, I don't think this woman is trying to get her $25 back, I think she's trying to make a little more.

That's how I understand it. AA claims that the fee refund can be requested with any lost baggage claim and that this woman hasn't actually bothered to to make any such request when filing the claim for her lost bag.

It's really a no-win situation for the airlines. I remember that my wife and daughter's luggage didn't make it back to FL on the same flight they were on when they returned from Ethiopia earlier this year. Thing is that they had a rather tight connection in DC which they made but their bags did not. UA flew the bags in on the next flight and would have gladly delivered them from Orlando to Tampa within 24 hours of arrival. We decided to get some dinner at Orlando airport instead and wait for the bags to arrive to take them home with us. Not a big deal. What were UA's options, really? To delay the flight for the sake of 4 pieces of luggage? To deny my wife and daughter a seat on their scheduled flight because the bags couldn't make it on?

What's hurting the airlines is this baggage surcharge which, personally, I think has gone a bit overboard. It's perfectly reasonable to set a limit (other than zero) for luggage that one can take free of charge - that limit should be driven by the duration of the trip. If people want to haul more stuff along, they should pay for that. If it's a free for all as it used to be, those who pack light pay for those who don't. That's an evil socialist set-up. It's un-American.

Sorry bro but the mash of goo is all on you. This Class Action lawsuit is - like an aweful lot of these class action lawsuits - about a few shysters getting rich with no discernible benefit to the public at large.

There's nothing restrictive about a $25.00 baggage fee. The alternative is a $25.00 higher fare whether you have baggage to check or not. I'd rather have the option to limit my baggage to a carry-on and save on the fare than being forced to pay up for someone else's bags.
