Got an RFE,Please Help....

I sent my AOS on June 28 and got an RFE in my email(yesterday) which i think might be for I-693 or I-864 .Due to some confusion with the CS ,i was not able to get Varicella and MMR( Live Virus Vaccine) on the same day and had to wait for a month.I got Varicella yesterday but the civil surgeon gave me only the vaccination part which when i checked with what she gave me the last time is seriously messed up.She(nurse or whoever) came up with some random dates which she didn't mention the first time she filled the vaccination part.Now i would have to go again and guide her as she is so dumb !! My concern is that she is now giving me only the vaccination part which doesn't have any space for civil surgeon's signature so should i get only the vaccination part without CS signature off course in the envelope provided by the great CS or should i ask her to fill the whole I-693 and also could that RFE be for I-864 which is also somewhat confusing,I have confirmed with many experts here and also lawyers if VA disability compensation considered as income(most of them think it is) as my husband makes only 14k in salary and gets 8k in service related VA disability compensation making the total income 22k which is more than 18k needed for a household of two.We are very nervous about this whole I-693 and I-864 thing .Please help.Waiting for your replies ...........Thanks ..

Okay....so, 1, breathe. 2, wait for the RFE. It doesn't do much good freaking out until you know what the RFE is for - it could be for something completely different. You have 87 days (typically) from the time the RFE was sent to get it in so wait until you get it, see what it says, and then people will be able to address that based on what the RFE actually says.

My advice is stop freaking out and wait for the official RFE so you KNOW what the issue is.

For the I-693 you need page 1, the vaccination page, and the CS signature page. The rest isn't needed.

Also, please use paragraphs. It's confusing otherwise.

I also received same thing.. it says there RFE - I-485 and with an x mark - Submit a completed and signed Form I-864 Affidavit of Support. And I guess we did this before twice already. So I don't know why same docs are being asked now. It says here as well. "The Service will process your Form I-765, Application of Employment Authorization (if submitted) within 90 days of the receipt of your missing initial evidence."

And can i ask.. Did you undergo an interview after your biometrics?

From the way the RFE is worded, it looks like you sent in a form for your co-sponsor and those tax forms, but not for him - the USC. Even if the co sponsor is the one with all the money, you have to send in the I-864 for both the USC Sponsor and the co-sponsor, and any tax forms for both of them.

If he didn't file taxes, you can go to the IRS office and get a "verification of non-filing" to prove he didn't file taxes.

The affidavit of support you submitted with the visa application was very likely an I-134 - NOT an I-864. They are not the same thing, and the I-134 cannot be accepted with an AOS application. The RFE notice you got specifically reminds you of this. You can't just photocopy the affidavit you submitted with your visa application and send that with your AOS application. You need a new affidavit on a different form, with new copies of the supporting documents.

Interpreting the RFE literally:

1. Did you send an I-864 affidavit of support with your AOS application, and NOT an I-134?

2. Is your husband the person who filled out and signed the I-864?

3. Is your husband the same person who originally submitted the I-129F petition for your fiancee visa? If yes, is there any difference in the name he put on the I-129F petition and the name he put on the I-864?

4. Did you include (at a minimum) a complete copy of your husband's 2009 tax return? A complete copy would include every form and schedule, plus every W2 or 1099 - basically, everything that would be submitted to the IRS when filing the return.

5. If he did not submit a complete copy of his tax return, did he include a transcript of the return from the IRS? If so, was it a "tax return transcript" and NOT a "tax account transcript"? A "tax return transcript" is a line-by-line listing of every number from every form submitted with the tax return. A "tax account transcript" is just a summary of the taxpayer's account, as well as changes made to the return after filing. USCIS won't accept a "tax account transcript".

Thanks a lot Jim for helping people like me and Brijhen. Sometimes people like me panic and there could be many reasons for that which people here don't seem to understand and don't want to understand because they think people like me are either crazy or stupid.Many people here are trying to learn english.Some are not tech savvy.Many people including me are born that way.They just freak out !!! Many don't have money that can freak them out too.Some people instead of helping others just become judgemental and biased.

People come to the forums to get answers not being treated harshly and people do make mistakes.It's very easy for few people to sit and just say mean things .Try to act nice to people guys.You guys are moderators and that doesn't give you any authority to be harsh with others !!
