Illegal immigrants bilked government of $13 million; some sentenced

ANDERSON, SC — A group of illegal immigrants in South Carolina and North Carolina were able to bilk the federal government of about $13 million by filing false tax returns for refunds, but some have been caught and sentenced.

Several of the men were sentenced by Senior U.S. District Judge G. Ross Anderson in federal court in Anderson. Two were sentenced on Monday.

According to U.S. Attorney William Nettles, from 2006 to 2009, two tax-preparation businesses operating in Spartanburg and Boiling Springs, and one in Forest City, N.C., filed more than 10,000 federal income tax returns claiming $22 million in refunds. They received about $13 million in refunds from the Internal Revenue Service before agents discovered most of the returns were fraudulent, Nettles said in a statement.

About 20 people were involved in the scheme, according to Nettles.

He said tax preparers claimed tax credits or deductions to which filers were not entitled. One such tax credit that was improperly claimed on a majority of the false returns was for child-care expenses. This credit can result in a refund even if no taxes were ever paid.

No restitution has been collected from those sentenced, said Assistant U.S. Attorney David Stephens.

“At this point we have not reclaimed any funds from filers,” Stephens said in an e-mail. “Such reclamation efforts will be by IRS through their Revenue side as opposed to the Criminal Investigation Division that I work with, so I cannot further address this question.

“There were monetary seizures from certain individuals during our investigation; however, the names of such persons and dollar amounts are not yet public information and I cannot share that with you,” he said.

Two people were sentenced Monday to prison after pleading guilty to the fraud and entering the U.S. illegally. In June, eight people, including four who appeared before Anderson, were sentenced to prison and ordered to pay restitution.

All convicted defendants will be deported at the end of their sentences, Stephens said.

“All of the defendants who have been convicted thus far are illegal aliens and all will be deported when they conclude their terms of incarceration,” he said. “As each defendant is sentenced a ‘hold’ is placed on them by (U.S. Citizenship and) Immigration (Service) so that they cannot be released without Immigration being made aware. “

Anderson on June 12 sentenced four people to prison and ordered them to pay restitution. They were:

— Edgar Carrillo-Borjas, 34; 24 months’ incarceration and restitution of $473,818;

— David Hernandez-Juarez, 34; 15 months’ incarceration and restitution of $137,527;

— Maribel Juan-Orozco, 31; 12 months’ incarceration and restitution of $150,000;

— Carlos Carrillo-Rodriquez, 27; 12 months’ incarceration and restitution of $50,986.

Anderson on Monday sentenced two more people in connection with the case:

— Ariano Canseco-Orozco, 20; 18 months’ incarceration and restitution of $382,500;

— Omar Maldonada-Cardenas, 27; 46 months’ incarceration and restitution of $1.2 million.

Stop with that moronic argument.

One is actually legal to be here, one is not. There is a difference despite ####### rhetoric like that.

Crimes committed by illegals are worse in the sense that they should not have been here to begin with. They committed a crime to get here, then comitt even more crimes once they are here... If they weren't here, their secondary crimes would never have happened. Well, maybe in thier home country, but not here.
