We are prepping to file and I had 2 quick questions. Her 90 day started 7/16 as she expires 10/16. How close to that 90 days do we need to be? Do I have a few weeks leeway? Also, here is what is in myu package. Please let me know if this works: Thanks All! (this is for daughter only as mother exp. date is Jan 2011)

Thanks guys. The reason I was a little concerned was because quite a few folks here have like affidavits, plane tickets, kids, joint properties and their documentation is up to 100's of pages. Mine, even with everything will be around half of that including photos which by itself will take up 10 pages. I do understand quality vs quantity concept, but with USCIS, I want to be sure but not go overboard.

We did travel a lot, we go out atleast twice a week but I never keep the reciepts  I guess for people filing new GC's they should start paying more attention to these small details.

If her 90-day window started on 7-16 and closes on 10-16, you should try to send it in rather early, just in case you get an RFE and also in order to get your NOA1 before your Green Card expires. Assuming you are still saving up, the latest I personally would send it in is about October 2.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Does the daughter have a DL or State id? Include that. Is she in school and you are both listed as her parents or emergency contacts? Include those. Have you paid for any health co-pays or other expenses not covered by health insurance - include those. Does she have a cell phone on the family plan? Include that.

You can file any time during that 90 day window that opened up on the 16th.

We also sent utility statements.

Thats the problem. All utilities are already on her name and have not changed since. Same thing with our phone records, I might be able to show her name along with mine on the monthly bill.

The ROC process is a safeguard against marriages that were entered solely or primarily in order to get a Green Card. What the immigration people want to see is documentation you that you and your spouse are happily married, live together, and share your life together.

You send anything that will HELP make your case. If the utilities are not in both of your names, you do not send them. If there's something missing that you think they expect you to enclose, you explain your situation in your cover letter. In case of utilities that should not be necessary.

How do you know what to send along with the I-751 form. I cannot find any specific information on the uscis website of specifics? Do you absolutely have to send it all of the "proof of relationship" with the form or only send it if they ask for it?

Thanks

Have you read the USCIS Instructions for I-751 ? Page 2 has a list of suggested items to send.

Two different utility company bills in two different names for the same time period and for the same address proves the same point as one utility bill with both names and one address. At least to most normal human beings it does. A cover letter saying "my utility companies only allow one name on an account, so we shared them out and are sending in a copy of each" should help build the case, unless you're being reviewed by robocop.

There are no hard and fast rules about proving your case to these people, you send in what your gut and your brain tell you, and you hope for the best.
