hi,

i sent my case i-485 on 07-21-2010 with everything by ups at the express address into chicago, in the same time my form I-765 has falls from my case by mistake,

i called the uscis then they said me until i receive the receipt from my case then i can send the form I-765 without fee,

and the web site uscis says if never you send the form I-765 without the I-485 ,we have to pay.

plz there is some people can help me about that coz im confused,and what i should do?

First of all, the I-765 is not needed to accept and adjudicate your AOS. It's free of charge and you should send it as soon as you get a receipt number for your package from USCIS. Don't worry, everything will be okay.

i paid for my case I-485 (1.010 dollars) and about the form I-765 says it coast 340 dollars inside the website .

so do you mean when i receive my receipt from I-485 i will send it attached with my I-765 and i don't pay them ??

Yes, exactly. When you receive your receipt from the I-485, send a COPY of it [NOT the original!] with your I-765.

So you need to make sure the packet you send includes an I-765, all of the evidence and relevant documentation listed in the I-765 instructions [iNCLUDING another pair of passport photos!] AND the receipt from the I-485. You will not need to include a check with this package.

Everything will be fine. The lack of an I-765 will not affect your GC application at all. The only consequence is you will get your EAD a few weeks later than you would have. No big deal.

It used to be that the I-765 required a separate fee but a few years ago that changed. Now, as long as you have filed the I-485 you can also file for the I-765 at the same time or afterwards without paying any additional fee. You need to wait until you get the receipt - the NOA - for the I-485 because this shows that you have already filed it and paid the $1010. You then mail the I-765 application with a copy of the NOA for the I-485. Make sure the application for the I-765 is complete with its own attachments. Even when you file the I-765 together with the I-485, the application packages are separated at USCIS and adjudicated individually.

If you hadn't filed the I-485 and were just filing for the I-765, then yes, you would have to pay the listed fee - but that isn't the case for you. You have filed the I-485 and can send in the I-765 as soon as you get back your receipt. No additional check is required. You're fine - you can sop worrying :yes:.
