what is the differnce between a congrassional inquiry and a letter of support for an immigration visa case. what is the maximum thing a congressman can do?

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

They can inquire at the CSC whats happening with your petition, they cant however expidite it :)

October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

October: 13th: Sent off AOS Package

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

December 14th: Biometrics completed.

January 17th: APPROVED AOS!

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

I have never heard of a ongressional letter of support for an immigration visa case - maybe you can provide some more information regarding what they said they would supply you with?

A congressional inquiry is when the congressman's immigration liaison makes a formal inquiry into the status of your case. For example, they contact the service center with your case information to ask for an explanation regarding why the case has not yet been approved and what the correct current status is. An inquiry can help when a petitioner has not other method of getting information i.e the service centers doesn't take phone calls or email and the case status online shows no activity.

July 25 2005 - Things start to get 'romantic'

Nov 11 2005 - Met in person

Dec 31 2005 - Engaged

March 6 2006 - I-129F sent

March 9 2006 - I-129F NOA1

June 10 Case Transfered to CSC - assured by USCIS that NOA1 date would be honored

July 3 2006 - IMBRA RFE in the mail

July 5 2006 - RFE sent with extra evidence (plane tickets, receipts, letters, emails, photos)

July 10 2006 - RFE received

Aug 8 2006 - Congressional inquiry - told 129F cases are processed based on IMBRA RFE

Sept 20 2006 - Called DHS - Was told another RFE was sent three weeks ago

Sept 21 2006 - Local USCIS office claims RFE is a request for 'initial' evidence - RFE must be lost or was never actually sent.

Sept 22 2006 - Congressional inquiry #2- told "We are working on your case, please allow 60 days" ARGGHH

Sept 26 2006 - 6 touches from all my investigating

Oct 16 2006 - Finally received the RFE that's been holding up our case. It's the IMBRA RFE that we already sent in and was verified received!

Oct 17 2006 - Senator Mark Dayton's office finally gets USCIS to pull out petition for special processing.

Oct 24 2006 - FINALLY APPROVED!

Jan 18 2007 - Interview in Vancouver / K-1 received

Jan 23 2007 - Sheryl enters the US with me

Feb 17 2007 - Wedding!

In my experience, and from what I have heard, it will accomplish nothing at all.

That actually depends on your specific congressman or senator. Some have really made a difference in a case, some have not.

However it doesn't hurt to try if your circumstances are genuinely out of line.

well wanna know the timeline of our case? we first got involved in the immigration in Jan 2004. so now you can imagine how long it has been for us to suffer and strugle.

I don't know if my congressman did anything, but a day after I wrote(a general question), my case was approved. I emailed and said to disregard my earlier email, but if he did do anything then thanks. He said he was happy to help.

CIS Office : Philadelphia PA

08/25/09 I-751 Sent to VSC

08/26/09 Package arrives at VSC

08/31/09 Check is Cashed/Clears

08/27/09 NOA

09/24/09 Biometrics

11/24/09 Approval letter arrives!

Your timeline doesn't indicate that your case has been very long, 2/25...

I think an NOA1 date of 2/25 (pre-IMBRA) with no approval yet certainly warrants a congressional inquiry, regardless of extenuating circumstances, as does your case iceyspots!

I think an NOA1 date of 2/25 (pre-IMBRA) with no approval yet certainly warrants a congressional inquiry, regardless of extenuating circumstances, as does your case iceyspots!

He does have an approval, read his timeline, 5/23.

Judging by what he wrote in his timeline there seems to be a problem, but not one of an extremely long wait. Unless he was told otherwise by the consulate/NVC

But they way they sounded on the telephone converstation, they are not in hurry to give me an interview date early. Same old bullshit just like with everyoneelse: "under reviewing process" Our time is too crucial. If i dont get visa within two months then i cant fly to USA till march 2007 even if i get the visa after my desired deadline.

Why would you have to contact a congressman in 2005? Your timeline shows that you originally sent your I-129F petition in February 2006...

Were you trying to file another visa before then ?

Is your fiancé IN Japan but of Pakitani descent?

Gugu, it's doubtful that a congressman will have any influence on forcing the consulate to move on giving you an interview date, but no harm in trying. If your case is under administrative review, they will not give you an interview date until they are ready. Unfortunately, your crucial timeline doesn't matter to them - in their eyes, if you have to wait until March 2007, so be it. The visa allows you 6 months to enter the US and can be extended by the consulate. In any event, good luck - hope it all works out for you
