My ex-husband dumped his IRS debt on me by doing an Offer in Compromise without me when we were divorcing in 2002. I am now married to a Canadian and wanting to find out about sponsoring my new husband to live with me in the States. The last of this debt - for 2003 - remains unpaid and I will never have the money to pay it. I wasn't even working back then! I know that they cannot try to collect after 10 years - but I need to know if this debt makes it impossible for me to sponsor my husband.

You better work something out with IRS as tax transcripts are needed for you to sponsor your husband. Forgot to add, if you owe money to IRS I've read account of people saying embassy personnel deduct that from your bottom line and you end up needing a co-sponsor.

The embassy also wants a letter from IRS stating you're in agreement on payment in installments.

This caused problems for me. My 2007 income was about 18.5k, just over the limit. At the time I owed the IRS about 10k. When my wife went to the interview the gave her 221g saying that I didn't make enough due to this lien. In there eyes I only made 8.5k for 2007. They subtracted the money owed to the IRS from income. Luckily I was able to send her my 2008 tax info, which was way above the limit. Also, at the time, I had been on a payment plan with the IRS for over 6 months.

Since we were IR-1, we filed the I-864 with NVC. I still don't know why NVC completed our case, and sent everything to the embassy. I wish they would have sent me an RFE at that point so I didn't have to deal with things happening half way around the world.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

I have a similar and related question. I had a tax debt owed on year 2009 over $10,000.00

I just recently paid off the amount in lump sum - and in the next 2 weeks or so my 2009 Tax Transcript will show a zero balance.

I am preparing to send my I-864 package which might be ready sometime around Mid August.

* Will I receive any income adjustments because I paid of this amount recently?

* What proof of payment should I provide above and beyond the Tax Transcript showing a Zero balance?

* Should I plan on providing extra assets or financial proofs because the amount paid was large and was paid recently?

I just did the math : income & assets - IRS = -50. 000 USD

So, our Co-sponsor would have to come up with 50.000 + 18.213 (poverty.guideline)= 68.231 USD. Is that correct?

And: what happens, if we don't know anybody that makes enough?

In cases where your ex-spouse "dumped" the IRS debt in your lap look-up "Innocent Spouse" or "Injured Spouse" & IRS. They have provisions to remove your liability for the debt. Bow if you knew the debt was incurred and chose to willfully ignore it then they probably won't do anything.

I have been thinking about this all night. It just does not make sense to me.

I am sure there's people here that have dealt with all these IRS/Settelment/CoSponsor/What-do-I-do? problems.

I would really really appreciate it if somebody could help me out or refer me to a member on VJ who has dealt with all this.

There are two types of transcripts, and IMO - you should get both types. The 'longer' one will still show the tax liability, maybe, but the shorter one will show the payments and the zero balance.

Thanks, everybody, for the input. I'll look into the "injured/innocent spouse" thing, even though it's been a long time now. I doubt they'll give me any edge at this point but, for the record, I don't think it's fair that the IRS can come after someone who's deliberately left out of an OC by a spiteful ex, for income that wasn't even earned by the innocent spouse, just because the innocent spouse signed a joint tax return without knowing the liability that puts them under. The other thing is that he and I were in negotiations with the IRS, and then he pulled out at the last minute and filed his own OC behind my back a few months later. Just to give you an idea of his credibility - he currently owes me $5000 in child support arrears, too.
