Timeline

My fiance from the UK first visited me in Milwaukee January of 2009. He was supposed to stay for two weeks, left on his connecting flight to Detroit, and decided to come back to Milwaukee and stay longer. He booked another flight home about two months later, staying a total of about 70 days. I have been reading about the visa waiver program, and I am not exactly sure if he signed up for it or needed to. What I am worried about is, we are in the process of applying for a K1 visa. If he didnt apply for the VWP, will this affect anything? He's been back about 5 times and has never had problems, but I still am worried. If anyone knows anything about this subject it would be greatly appreciated, and hopefully put me at ease!

Te pre clearance is ESTA.

I'm not sure I understand your reply. If he left the country and came back and was let back in fine multiple times, should we be ok? ESTA is a chip in your passport, correct? So they will be able to track when he left the vountry after that first visit? He didn't do pre clearance as he was only planning on being here for two weeks, and decided to stay longer after flying to detroit.

Are you automatically allowed a 90 day stay upon entering the US from a country that's part of the VWP?

Yes he was able to stay for up to 90 days on the VWP. I think you will be alright!

ESTA has nothing to do with your passport.

VWP entry is for 90 days.
