Joint sponsor not included past three year tax returns

Hi everyone

Just getting ready to send my adjustment of status forms but as I was going through our joint sponsors I-164 I noticed that on Q.25 which asks about tax returns she has just ticked the box stating that she will only be sending the most current tax return copy in...and then she hasn't filled in the part where you have to write total amount of tax returns for last three years. So, I have her tax return for 2005 but no info at all for 2004 or 2003. If i sent it in as it is will I definately be heading for a referral? She is well above the poverty line and has had the same job for years. She is currently on vacation for around 10 days or I would ask her - i don't want to delay sending the forms till then if i can help it.

any advice appreciated!

Hi Englishsammy!

All you need to send is the one copy from the last year. However you do need to have that information about her last three years. Can you contact her while she is on vacation or does she not have her W2s for those years?? If she has them she can just let you know what it is but if she doesn't you will have to wait. As far as if you should take the chance of sending it that is completely up to you two. I would not take the chance for the simple fact that waiting an extra 10 days does suck but it could take longer to receive an RFE and for them to process it! The USCIS is really picky when it comes to the financial support aspect of the applications so I would definetely not take the chance!! Good luck!!

Now that I think about it you are right the new I-864 forms only require the most recent information! Sorry about the confusion All these old and new forms jumbled in my head I can't keep them straight!!
