Hello I am worried because im about to leave soon but she dont have a interview day yet. I read she have 6 month to depart her country once the visa is approve then the 3 month here in USA for a total of 9months window for us to get married.

but im worried I wont be able to come back on leave because next year would be my last one. because I be back by the end of july, I dont know if they would let me take leave since Im not gonna be there for the full 12 months.

my question is, is there anyway for her to extend the visa before the expiration day for her to leave her country. or once she is here(USA) if im not here yet.

any visa extension needs occur before she arrives... there is no extension to the 90 days after arrival. Period. Simply explain to the consulate the reason for the extension request. Any extension request is at the discretion of the consulate and I would think you being deployed would be a pretty good reason

I have read of people asking the consulate to wait before issuing the visa. There is a lady from Canada who is pregnant and wanted to wait until after the birth so the consulate told her to send in her passport when she was ready to have it issued. She would have to ask her particular consulate. The previous poster was right though...there is NO exceptions to the 90 rule. She MUST get married within 90 days of arriving to the US.

10/04/2010 - Received interview letter in Mail

11/09/2010 - Interview-APPROVED! 112 days

11/09/2010 - Card Production 11/22/2010 - Green Card received

ROC Journey

08/11/2012 - Eligible to file for ROC10/11/2012 - sent in I-751 (late)10/16/2012 - received NOA 11/20/2012 - biometrics

hi. my fiance will be deploying too dont know yet how long he will be deployed but we are guessing 6 months. Fiance called the USEM about it and they given us a year to schedule an interview. i will call USEM again sometime this month to clarify it and ask if we need to submit papers as proof of deployment for the extension. coz our k1 application is only valid till oct. that's what's written at our noa2.

If you are stationed on an base that is U.S. imminent domain and considered US soil. She could come to you at that base and you could be married on the base and it would transfer. USCIS would recognize this as a legitimate marriage. As always, if you call the USCIS and ask them directly you can find the official answers to these questions from the USCIS directly.

I believe you can get an extension. Make sure you send her a copy of your deployment orders to show the consular when asking for the extension. One of my soldiers did the same thing!! The visa was granted but his fiancee didn't pick it up until he returned from Iraq. This is a genuine reason for the extension.

On the contrary, if you are just PCSing to an overseas base like Germany or Korea, she can get the visa and you get married on base at your new duty station by a military chaplain since that is within U.S jurisdiction. Hoooah!!

Thank you all for the replies I feel much better now that it can be extended, but is up to the consulate.

I am heading to Afghanistan that why I am worried. but I dont have the deployment orders yet usually you get that like a month or two before the departing day.

When would be the best time for her to ask for the extension right as she enter the room for the interview or after the interview?

should I call? where? i got my NOA2 Jun 23 2010 and is valid until 10/23/2010 would that affect something?

also I still have to send her some papers like the TAX papers etc. I did a Income Verification when I start doing my K-1 in March so the one I have is dated March 2010 would that still be good or should I get a new one nothing have change in my job/work or pay.

does the Income Verification letter have to be dated after the NOA2 is receive?

cause I have one from when I start the whole process dated March, and I just got the NOA2 not long ago would that cause any issues at the consulate in Lima?

I already have the Tax transcripts for the past 4 years.

today I contacted the bank to get the letter from them with the date I opened my account, balances and deposits for the past year.
