Timeline

My fiancee will finish her final year of school in Germany in July of 2007. She wants to come to US after graduation. We are trying to figure which visa will allow her to start working as soon as possible? (Just like everyone else!)

My research so far shows that we are looking at 3-6 months whether we choose to go after a K3 or K1. (except that it is possible to get a temp EAD for 90 days, but a gap often develops between the 90 temp and the 1 year EAD).

Does anyone know of creative solutions to expediting the process? The one thing that comes to mind is getting married a few months before July, and then apply for a parole and return to school. I think she would be able to get three weeks of school off; is this enough time to complete the necessary steps and get an AP?

I'm guessing that the stress of trying to pull this off out weighs the benefits, but your thoughts are appreciated.

Also, can she go to school while waiting for an EAD (on a K1 or K3 visa)?

I hoping there is a way for her to not have to sit around and do nothing while waiting for the EAD!

Your research is correct. If there were a creative way to expedite the process, we'd all be doing it! ;)

You are trying to plan against a ficticious timeline which is extremely difficult. No one here can advise about timelines... a lot depends on whether you receive an RFE (or more than one). And if something like IMBRA is enacted without warning again, everyone's timeline is up in the air. Case in point: the recent transferring of cases out of Vermont due to workload balancing among the Service Centers... The IMBRA dust hasn't settled enough for anyone to make any accurate predictions, especially into 2007.

As far as going to school is concerned while awaiting AOS is concerned, someone who is more knowledgable in this area will need to comment. My guess would be 'not possible', as that would require a different visa if she were not a resident of the US...

Have you looked into the CR-1 immigrant visa for spouse? On entry she has the green card with no adjustment of status as there is for the K visas and can work basically straight away.

As aussiewench suggests, an Immigrant Visa would solve your dilemma. Marry sometime soon, file I-130 while your new spouse remains abroad finishing school and carry through the CR-1 process. When she enters the US, she becomes a Permanent Resident immediately and is work authorized from Day One.

I agree with donnaal, she won't have to wait that long. and when she arrives she will be busy anyway assimilating and looking arround which companies there are. I am not sure of the legal status but I guess it might be possible to already start writing coverletters etc. and say I will have a work permit in 3 months. I was in a similar situation, I finished university last september and have not worked yet really because I am on and off visiting my fiance. but is is so worth it :-)!

Thanks for all the input. It looks like a DCF will work since I will be working in Germany for the next 9 months. It is nice to know all the options... thanks for your help.
