Hello,

I had my interview on July 9, and everything was well, my case was K-3/K-4 but NVC informed my husband that had been canceled, and told him to send the I-130 for my daughter(his stepdaughter). Since April 16, the Noa-1 of my daughter has already arrived, but three months and has not yet reached the Noa-2. Someone's in the same situation?

I'll assume he did not.

Is possible to get expedite NOW, but must do some serious wrangling to get the casefile out of it's current queue - he'll have to make some phone calls to USCIS and possibly the immigration liason staffer with his US REP / US Senator's Office.

thanks for your reply, my Husband did call to USCIS and they told him that cannot expedite, just if he is a military, or if my daughter is a baby, she has 12 years old, so, we really dosen't know what we can do, they always say that we need wait 5 month. I sent this link for my Husband, hope we can find some.

Unfortunately, the ppl who answer the phone are useless, sorry.

Husband needs to ask for 'Visa Specialist' or 'Immigration Specialist'.

An expedite is do-able, but at this stage, must have the 'proper input' into the 'proper office'. The front-line tele-operators at USCIS are not the 'right ppl' to talk to, about this, but must go 'through and around them', to get to the right person. Sorry.

I also mentioned talking to the Immigration Liason Staffer at the US Representative and US Senator's office - they are useful, always.

The phrase that pays - 'I-130 expedite for CR-2 visa, CR-1 visa holder already approved, need expedite for the child'.

Same EXACT thing happened to us, but we were aware of the expedite (thanks to Darnell) and his case caught up to mine within two weeks.

HI my name is Burc and my wife led me to this website. I have read the comments above that you were in the same situation as we are. How did you get the case expedited? What phone numbers did you call and if you went through USCIS how did you get around them to talk to the correct person? Of course USCIS is no help just telling me that the case can take up to 5 months with a child younger than 21 yrs. old. Please reply so that I can get something going. Thank for your help.

Can you give me more detail about how to get through and around the USCIS operators? I tell them our situation but it is seems like they would be more helpful in regards to our case. DO I just tell them "'I-130 expedite for CR-2 visa, CR-1 visa holder already approved, need expedite for the child"?

Just let me know so that I can give them a call to get this resolved.

their situation was a little bit different ( no visa interview yet, paperwork still at NVC)

but they used something I outlined over at http://www.visajourney.com/forums/topic/255138-k3-k4-visa-converted-to-cr-1-by-national-visa-center/page__p__3918125#entry3918125

IMO, that's not exactly available to you, because you've already filed the 2nd I-130 for the CR-2. It's already at USCIS, in the 'regular' queue.

and

you'll need to 'do something else' using the telephone, email, fax n maybe even postal letter.

Strongly suggest you start with the Immigration Liason Staffer, mentioned above.

BP - when you talk to USCIS tele-operators -

keep in mind? please?

you need some one else, not the level of staff that answers the phone.

You need an 'Immigration Specialist' or 'Visa Specialist' - this is a trained person with semi-god computer access, usually can move things about, make things happen, etc etc, unlike the first-level human you will talk to/with. Once you get the first level human, you ask for an Immigration Specialist .

Once you get that person, THEN explain what you need.

I suggest, also, that you concurrently engage the Immigration Liason Staffer human at the US Rep/US Senator's office. You've got 1 US REP and 2 US Senators, call them on Monday, find out the name of the Immigration Liason Staffer, GET THAT PERSON, then talk with that person, explain that you need to expedite an I-130 for a derivative CR-2 visa, as the CR-1 visa for the spouse has already been approved.

Well no luck!! I contacted the Immigration specialist and the case has to be life/death situation!! Any forms filled outside US for the CR2 cannot be expidited. So I don't know how everyone done it and succeded but they refuse to help my case even after I asked if I could pay to get it done.

What now!!!

Also I had contacted the US Rep. Office and she told me the same thing.

Well that is what they said. My step daughter's CR2 for was filled/submitted inside the US but they are resisting on giving me any information to expedite. Like they telling me life/death is the only way that they would even think about expediting her case. I think they should have expedited her case since UCIS canceled the K3/K4 visa at the beginning of the year. It sucks now because my wife is finished and now we need to wait for her daughter to even get approved and forms submitted to Brazil for the interview. Let me know your thoughts.......

Glad to hear that your case is finally expedited!

What did you learn in the process? The operators in USCIS are mostly useless to deal with. Also, it is very painful to get them online as well, after a long wait.

Can you please outline here, the exact content and the emailid that you addressed to CSC? Of course you can mask the sensitive data.
