Timeline

I am in the process of filling out the I-864 form. I do not have sufficient income at the moment. However I will be using a joint sponsor. Will the Joint sponsor be filling out form "I-864" or form "I-864A".

What is the correct answers to the following questions -

Enter the net cash value of real-estate holdings. (Net means current assessed value minus mortgage debt.) - I do own a house worth @ $320,000. What value should I enter.

Your household member's assets from Form I-864A. (Optional) - I will be using a Joint sponsor should I be filling out this section?

Assets of the principal sponsored immigrant. (Optional) - My wife has assets in India, not in the U.S.A. Can I leave this section blank?

Is there any other information I need to add apart from this.

P.S. I have included my tax returns and W-2's from 2009, 2008, and 2007.

I will include a statement that highlights the balance in my Checking and Savings account as well.

1) If your co-sponsor lives with you: i-864A, if not, i-864.

2) You should enter the net value. 320K minus what you still owe on the house.

Keep in mind tha assets are valued at 1/3 or 1/5 (forget which one right now) of their actual worth for the purposes of the 1-864

So, if your co-sponsor's income is enough, I would keep things simple and not include assets

3) Depends. Is your co-sponsor a household member? If not, then the answer is there will be no i-864A, so you would leave this section blank

4) You can leave wife's assets out of this too.

Generally for assets, they would like to see that the asset can be liquidized quickly if the gov't goes after you for the money. And I'm not really sure that a house counts for this purpose. Also as I mentioned, assets are valued at 1/3 (or 1/5 I think for the co-sponsor) their worth. Example: if your income is short by 5K, you need to show assets that are worth 15K or your co-sponsor needs assets that are worth 25K.. something like that.

So basically, if your co-sponsor's income is enough to fulfil the 125% poverty minimum, don't complicate things with assets, whether they are yours, co-sponsor's, or your wife's.

Timeline

Just to be clear, the I-864A is not just for a co-sponsor living in the same house as the primary sponsor. The I-864A is for a qualifying relative or dependent of the primary sponsor, or the sponsored immigrant, to combine income with the primary sponsor to help them qualify. This is substantially different, and potentially much better, than a regular joint sponsor because neither the primary sponsor nor the household member need to have income or assets high enough to qualify on their own.
