Hi,

I filed a I-130 for my wife and got an e-mail asking to gather other documents including the I-864.

We live in Ukraine (My wife(who im filing for), 2 children (both US citizens from birth abroad), and I (US citizen)).

Since I did not have any income during the past 3 years, can my mother(US citizen living in US) file the I-864? Should I file one as well eventhough it will be pretty much empty? If I do have to still file a I-864, should my mother file the I-864a as a joint sponsor or also a I-864 since she is pretty much the only sponsor with the required income?

Also, since for the time being, we will all be living together, does my mother have to be able to sponsor the entire household (5 people including herself) or just her and my wife (since our children and I are citizens)?

Your mother can be a sponsor

You will provide an I-864 as well

She should do an I-864 because at the time of the filing your household's are not joint

Her household plus the alien... you and the kids are not (or not yet) a part of the household and won't be at the time the I-864 is filed

So my mother and I both fill out the same I-864 forms... In this case, is she considered a sponsor or co-sponsor?

Also, Does she fill it out and mail it to me or does she fill her form and have to hand it in the US?

You can use more than one sponsor (in case, you don,t the income requirement even with your mother's sponsorship).
