Thanks for your help. He didn't work for the 3 years here in Canada, cause we were doing his paperwork. This is his first job in 3 years. He didn't file taxes in the USA cause he didn't have any income to report. Does he need to write a letter explaining the reasons on not filing?

I filed to the USA with -0- income, my accountant in the USA did it. I had -0- I spoke to the IRS and she said that no i didn't have to file but because I'm re establishing I should. And the reestablishing was not for the immigration it was for the IRS. I've been gone a long time over 20+ years and she said I should file back and I did.

My accountant did it for me.

My advise on this is he makes 44k and there are only 2 in your household, that would qualify for the money but I would bring his pay stubs now to show he is earning it and maybe a letter stating when he got his job and why he does not have tax returns as yet since he has not filed because he had -0- income in Canada and was not required to file. If your interview is in March or later of next year he can file his taxes for this year and he will have a return for one year and he will have the W2 and he can explain for the other years and show proof with his canadian PR card.

Does he have a lease from the apartment?? I would bring that to show domicile just to be safe.

If he was here he must have been a permanent resident.

I have -0- income USA but I will qualify on assets but as I said I did file -0- returns.

Hello Everyone,

I haven't read these forums for a while, but my interview in Montreal is this coming Friday (Nov 19th!!) I know we have a pretty airtight case, but I'm starting to get nervous anyway. My husband is not coming with me to the interview, as the flights to Montreal are not cheap and he doesn't get a ton of holidays anyway. Our lawyer told us it will all be fine, since our case is very straightforward.

I'm wondering how long it normally takes to get your passport back?? I'm in Vancouver. My lawyer told me I could ask them if it would be possible to get my passport back from them in person - the same day!! He said they may not be able to do it but it wouldnt' hurt to ask - has anyone heard of this??

My interview is less than a week before US Thanksgiving, and I'm nervous that because of the holiday the processing may take even longer, and I'm going to be so anxious to get down to Seattle! How long does it usually take to get your passport back from DHL?

Also, I'm curious about what actually happens at the time you actually cross the border. We'll be driving across. But because it's so close to Christmas, I will definitely be coming back to Canada within a week or two of my entering the US to see my family, etc. My lawyer told me to ask them (at the border) for an I-551 stamp in my passport, which will allow me to cross the border easily until my actual green card arrives in the mail in a few weeks. Has anyone heaerd of this?

I can't believe it's almost here! I have butterflies in my stomach already!

Thank God, my passport came back EXACTLY 2 business days after the day of my interview... We picked it up at the local DHL office. We were so happy that it was that fast!

Now, many have written that they asked nicely about getting the passport back the DAY AFTER the interview because they needed to travel back to the US or some other matter, and in some cases the consulate was nice enough to give their passports back the day after.. so it wouldn't hurt to ask :)

The new DHL system seems to be very quick, most people are receiving them within 5 days of interview (usually 2-3 days!). You may squeak through and get yours before T-giving. You can absolutely ask them if you can pick it up next day, although that is normally reserved for people who are currently living/working in the US on another visa, but there's no harm in asking.

When you do POE, you should automatically receive the I-551 stamp on your visa to show it is 'activated'. The visa with the stamp is then used as your temporary green card until your actual card arrives - you can use it to cross the border, etc.

You don't have to mention to the POE border guard that you are returning at xmas, but if questioned you can certainly give them good reason for returning so quickly.

Don't worry, it sounds like you've got your ducks in a row. They don't try to make this process difficult (just expensive and time-consuming :D ).

Good luck!

Those of you who did POE, then came back a few days later back to Canada etc, what questions did they ask you on your initial POE?

Did they not check how many pieces of luggage you are bringing? Doesn't it look odd that you are carrying only a carry-on luggage (for example) at your POE, whereas it is supposed to be your "official" move to the US?

Are they expecting a big list of luggages on the POE and does the lack of a large amount of stuff on the POE look bad?

Also, does the officer @ POE ask you which city you are going to, where u will live, do you have a job yet, is your house sold yet, did you quit your old job yet, etc??

Its frustrating getting different answers from different officials...

I am a Cr-1 as well not dcf but I poe'd just a few weeks ago.A friend of mines son wanted to go shopping over at a mall just across the border. We were going to Poe on the 1st but due to this I decided we would just go through, do some shopping come back and leave the next day with all my things. We arrived at Massena border very small crossing and we were asked the regular questions about liquor, tobacco, and declaring any money etc then where I was moving, with whom.. Then told to go to secondary. I was not asked anything except if the address on the ds230 was correct, I said yes and that was that. I asked if moving my stuff the next day or later would cause any problems and she said no you are a resident now.

The next day I was asked the same usual questions and what I was bringing with me.. I said personal belongs and Off we went.Oh and we were asked how we met. I did bring a list of all my items, example box 1:clothing,shirts,pants,socks, box 2: Toys, stuffed animals.

I do not think that what you are bringing with you will matter. I brought 3 suitcases and 6 boxes..was a HUGE move hehe.

I would just tell them you will be bring more over at a later date as I think you have a year to do so.

Actually you have up to 10 years to bring your belongings in.
