birdned, Hi, sorry to be a bother, can I please have DOS phone #, I'm searching and not finding.

Also in case anyone is interested, it's probably known, but just making sure, you have to go to a private company to do the RCMP clearance. I called and they said it's now private registered with them. $40 if you have a clean record I believe and about 10 business days. I hope that's all it is.

But may I please have the DOS # to call (does it work from Canada) I would really appreciate that.

If I can ever help with anything, please just ask.

thank you everyone and congrats to all who are getting interviews and packets.

It's great to see everyone getting their packages!! I was "mailed my package" on September 10th however I still haven't received it... are most people that are receiving packages located in eastern Canada? I'm just hoping that it's just taking an extra day or two for western Canada  . However again I am worried because I never did receive my first package by mail (sent to me on March 28th), I really hope that this is not the case again. Because of this, I am also hesitant to book my appointments, just in case I don't receive the paperwork in the mail. Does anyone have any ideas on what I should do?

If they've mailed you a P4, that means you're eligible for interview, so you are fine to go ahead and book a date. Once you've booked your date, then you can book a medical. You will want to bring your P4 letter to that, so give it another week or so, and if you haven't received it yet, then ask them to send it again. But there's nothing in it that you need to book an interview.

Watch out for the glitch, though, it takes you to a 'login' page for CSC. Ignore this, press 'back', and try again. If that doesn't work, call your local access number. These are found a page or two back in the thread.

Hi, I just received my pkt4 last week. My wife is a US citizen and we have three kids (ages 8, 4 and 2). On the first page of the packet it says "each family member planning to immigrate must appear on the appointment date, subject to the exceptions noted in the personal appearance instructions at http://travel.state.gov/visa/immigrants/info/info_1335.html. To request a waiver of the personal appearance of a child under the age of 14, please contact http://canada.usvisa-info.com. I have been looking but can not find out any additional information about this. I would love to not have to bring the 3 kids from Vancouer to Montreal. Does anyone know any additional information about this?

Hi Sean214 - has your American wife lived down in the States for at least 5 years? If she has, your kids can claim their US Citizenships, and then they don't have to go through the whole Immigration process. We did this for my son (my husband is a US Citizen). It's MUCH easier than dragging them through the whole Immigration process. Getting his US Citizenship was fairly straightforward. My husband had to provide his birth cert and proof that he lived down there for at least 5 consecutive years (things like high school or University transcripts and tax returns are good proof). You need to have originals of your kids birth certs, and they'll want to have a look at your Canadian passport. We took all of it down to the Consulate in Vancouver and they looked after it all there. The whole process didn't take more than a few weeks for us. I can't remember the exact website we went to to find all the info, but if you Google "claiming US Citizenship for children" or something of that sort, you should find the info. If you run into a problem let me know and I can look back through our files to get more info for you. If you get moving on it quickly I bet your kids could have their US Passports before you get your process completed!!

Good luck - and I hope you don't have to drag all those kids to Montreal!! I'm VERY grateful my parents will be able to look after my son while I go out for my Interview in November... A 5 hour plane trip each way with a toddler is NOT my idea of a good time!

SO, now that our interview is scheduled, we are focusing entirely on proving "intent to re-establish domicile"..

Maybe we need a diff thread for that, but those of you who are living outside of USA and (that should be all of us because we did DCF), what are the CONVINCING factors you will be presenting to Montreal to prove you are "re-establishing" domicile in USA?

-should the petitioner move back to the USA (or will they reject that, cos petitioner is moving back after interivew is already scheduled)

-job offer letter, daycare registration, moving quotes, selling current home/getting a place in USA

-voter registration, bank account, driver license...

What is the one or two things which almost always guarantees "re-establishing" domicile (if there is such a thing)?

I am guessing letter of offer (employment) and perhaps you sold your house and got a new one in the USA?

Adichiwa & superspur, WE will be EAGERLY and ANXIOUSLY awaiting your feedback after your interviews tomorrow!!! Same goes for everybody else, please provide feedback as soon as you've had yours....

Thx,

Choles

Hi Heatherd29 - no she has never lived in the States. Her parents are both US citizens but she was born in Canada and has never lived in the States. I wish we were able to do what you were able to. I am not looking forward to two 5 hour flights with three young kids. Thanks for your response.

Hate to be the bearer of bad news... Did some research for you and came across this page: http://www.richw.org/dualcit/law.html#CitByBirth

I states:

The US law on citizenship by birth incorporates two traditional legal principles:

* ius soli ("right of the soil"), under which citizenship results from being born in the US, and

* ius sanguinis ("right of the blood"), under which citizenship results from having an American parent or parents.

Each of these principles is subject to certain restrictions. For example, children born in the US to foreign diplomats are not US citizens. Also, children born abroad to parents who have US citizenship but have never lived in the US are not US citizens (this rule being designed to prevent the proliferation of endless generations of foreign-born and -raised "Americans").
