okay so after an interview(HCMC)back in April my wife was give a blue slip. so we got all the Supporting documentation ready to turn it in.

On the day of turning in all the Supporting documentation(5/26/10), one of the CO just take all of the documentation without an interview and told my wife to go home and when they finish reviewing the document "AT A LATER TIME" they will notify my wife directly by mail to let her know if she approve or not.

*so am here to ask if anyone is in the same problem as i am? and how long does it take for the CO to review my case? it has being two month of waiting for me already and still NOTHING.

* can anyone give me an answers please?

I'm gonna move this to the Vietnam forum - you'll get more exposure there. Not so many ppl read the K-3 forum these days, as the K-3 is mostly a 'dead visa type'.

those were great info Scott thanks. i also read one of your other post saying that cases like mine, should take 90days right?

* here my case is in AP right now(since 5/26/10) pretty much waiting for an CO to approve it. my case is that we have a baby "ofcourse together" and my daughter have her USA PASSPORT already so we just waiting for mommy to get her visa :). so does it help with our case to a pink slip better since we have a baby w/US PASSPORT? ohhh my daughter is in vietnam with my wife.

HCMC AP cases have no specific time associated with them... By DoS standards they should be done in 3 months but that is not the case for cases in AP now... The cases that went through AP last year were around 90 days as they got AP in July and got out in Oct... but since then many have been in AP far longer than 90 days..

I have a theory that they wait until the end of fiscal year to clear out AP's... many disagree with this but we will see between now and October... for whatever reason the CO did not review the file on the date the docs were submitted and has decided to let the case sit a while pending additional investigation... for many this includes phone calls from the consulate asking you, your SO, family members, friends or neighbors questions... sometimes they send a couple of guys to her village in person to ask questions... not long after the consulate makes those calls, the SO gets a letter in the mail with the decision...

Fred waited 271 days last year and Frank is at 270 today... there is often little that can be done to get the ball rolling once it is in AP... for some USC's, going to the consulate many times has possibly triggered action, but for others many visits yielded additional frustration... USC's can get into the consulate on Tues and Wed afternoons..

You can call DoS for a status check any weekday 9-5 as they have computer access to the case and can see what the consulate has input into the system.

I am hoping we dont see another surge of AP's in July Aug as was the case last year..

Many couples have children and have been denied for one reason or another... Having a baby does not ensure a visa...

WOW 270 & 271 days that frenky long time. i wish they would hire more CO so they don't have so much file-backup. or separate cases in category.

What I meant by the baby thing is that many people think because they have a baby together that the government will approve the visa for the wife or fiance because of the baby... did they ask you for a timeline of the relationship?

No they never ask for timeline of the relationship, i think because we have the "Consular Report of Birth Abroad" and "birth certificate" and a copy of "USA Passport".!

I think you're missing Scott's point. There is no question your baby is eligible to come to the US. What he is saying is that having a baby does not increase your wife's chances of getting a visa. That's a common story going around Vietnam that all you need to do to ensure getting a visa is to have a baby together. It just ain't so. I personally know a Viet Kieu living in San Jose who has a baby together with his wife, and she's been denied a visa twice now. Their baby is now almost 3 years old.

The "timeline of relationship" is something the consulate in HCM frequently asks for on the blue slip. It's a statement, signed and notarized by the US citizen petitioner, describing the progression of the relationship with the VN beneficiary.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

82 days in AP still no update. from what i see alot of case in 2010 will be review for at less over 6month.

i think this is B.S. for them to keep us away from our family this long. my daughter said her first word "ba, ba" 3wks ago and i was not there to see her and be with her. that just kills me.

any 1 have any news at the CO office for AP/AR ??

They have been doing investigations on our case for almost 1 month now. Phone calls asking people questions for 30 minutes to over an hour..and investigators going to her house asking questions of neighbors..... others in AP have been waiting over 300 days... There should be a bunch of decisions in the next 60 days if they do what they did last year... its a waiting game when the case gets put in AP

i read this on another blog, so this is true that everytime you send in an email to check your case status, it will be move or maybe move to the bottom?

• Does AP have any time frame for completion? NO AP can last anywhere from days, weeks, months and in a few cases years.

Anyone that happens to be given a 221(g) or Administrative Processing letter must be patient and let them do their work. Do not call constantly and ask about your case. Remember each time your case is moved it can then end up at the bottom of the stack and your time can be extended. Each case is different so you cannot judge your case by any other and each consulate/embassy may have a different average time for completion of AP.

not true... if you call DOS there is no entry made in the system.. an email to the consulate is responded to by an IO whom has no real impact on the status of the case and usually just provides a copy paste response... the only way IMO that an email can delay AP is if you say something in the email that pisses them off...

As far as HCMC you can no longer call them directly any way.. DoS is the only phone info...

AP will be the life test to see how much patience you have.. when you get through AP you WILL have far more patience that you could ever imagine...

When you are in AP there isnt anything that can be done.. It sucks.. we all agree on that.. it is what it is and they do what they want. If there was any mention in the 221g of the relationship not having enough supporting evidence, one can hand deliver or mail additional evidence.. this may delay the process or it may not... Fred used this to get thier attention by going in regularly to add more evidence.. they finally gave in and granted the visa... even if they didnt mention a lack of evidence you can still force feed them more...

This has to be the biggest test of our relationship! And am pretty sure alot of people feel the same. There got to be a way where we can chance this for the people after us.

Like go to senator or house rep to chance the law or act so that the CO do Not have that much power. Cuz it feel like they are god with all the power in the world to waste our time LOL!

Well anyway thanks scott let keep in touch. I'll post more updates when I have any.
