Where does a waiver play a role here?

On interview day. And After Interview Day.

So, file I-130, go through NVC Processing, get appointment date, get medical exam done, show up for interview, with expectation to get denied.

AND THEN - file the waiver.

IMO, if you explain everything about yer circumstances, I don't smell a problem for a VO to grant the waiver, sometime AFTER interview day.

some goofy nomenclature (since that site says CR-1 visas)

when an I-130 petition is approved, the foreign spouse is allowed to apply for a visa, the DS-230 is filed (The Visa Application itself) to NVC.

FINAL ADJUDICATION occurs on interview day, not during NVC processing.

It does not really matter that you can not submit a waiver in anticipation of a declined visa, it is what it is and it does make sense.

I am going to assume that she was told she had no chance of getting a Visitors Visa, which sounds right.

K3 has been dead for sometime. Sounds like the lawyer did not know that?

Update - nothing new actually. It has been one month now since the CBP stole my wife and destroyed my life. Hope they are happy. Maybe they should look south sometimes at how bad a job they are doing down there.

Sent the form I-130 a little over two weeks ago and the check hasn't even been run through the bank yet, so I guess we are in for a long wait.

Hope everyone else going through this bs is having better success.

Yes, sorry I did not included that info. I can't get the time line to work on this forum and don't really have time to figure it out.

The service center received our Form I-130 on August 16, 2010 and the status is still initial review. I don't know if I mentioned it, but I spoke with my Congressman's liason on immigration and in the face to face he made it sound like he could get the 130 expedited, but a few weeks letter I got an email from him wishing me luck and sating that he can't do anything else. I am not sure if he even tried.

I have recently discovered about how to apply directly with USCIS to expedite the process and I am going to try that.

ya, I'm asking about the postal letter, the 'receipt notice'.

If you have that letter,

then in it,

is the Receipt # -

and ya need the receipt # when talking to USCIS via telephone.

I assume you have it, you mention 'status is still initial review' and thats a status from the USCIS online status portal thingie, one can't check status without the receipt #.

Since you first started this post, I've learned a bit about ISOs, Immigration Service Officers, at USCIS - see http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5

Suggest you speak with an ISO, soonish, about that expedite, as well.

Don't bother with any CSR, Tier 1 Subhuman, the first human you speak with - they are useless. But ya must go through them, each time - to ask for an ISO.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Received Email today, Jan 24, 2011 about NOA2. Hope to have the hard copy soon and interview sooner!

hi wshc congrulation for your NOA2 and i think after 18 0r 20 days you got your ds-3032 and NVC Case Number and Invoice Identification Number soon
