Hi, everyone. Im a permanent resident here in the US. Am I already allowed to petition my parents? I have a step dad, because my biological dad died when i was 16. Is that okay that my mom is using another last name? Please anyone who knows, kindly reply. Thanks!

An LPR can only petition for their spouse, children, and unmarried adult sons and daughters. An LPR cannot petition for their parents. Wait a few years, become a US citizen, and then you'll be able to petition for them.

not until you are a USC. you'll be able to petition for your step dad if the marriage took place before your 18th birthday. If not then you would have to petition for your mom and then she would have to file for her husband.

the last name doesn;t matter because you will need to send copy of your birth certificate where she appears as your mom to show ties to you and that she is your biological mother.

for me, it was the other way around, my USC mom petitioned for me and she remarried. my dad died when I was almost 11. I had no problems because of the birth certificate.

they are separate petitions if you are able to.
