CORRECTION: RFE I-485

Hello everyone!

I just got a letter from USCIS requesting more evidence, and I have no idea how to proceed.

This is the letter:

REQUEST FOR INITIAL EVIDENCE (I-485)

This Office is unable to complete the processing of your Application to Register Permanent Residence or Adjust Status, (form I-485) without initial information. Submit ALL the information requested below at one time. Failure to do so will result in denial. You must submit the information within 87 (eighty-seven) days to the following address: U.S. Department of Homeland Security, PO Box 648004, Lee's Summit, MO 64002. Include this letter with your response.

The Service will process your form _-765, Application for Employment Authorization (if submitted) with 90 days of the receipt of your missing initial evidence. This is pursuant to Title 8, Code of Federal Regulations, Section 103.2(b)(10)(ii).

All copies must be clear and legible. If you submit a document in any language other than English, it must be submitted with a full English translation. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. You must submit both the foreign language document and the English translation.

If you have a question about immigration procedures, or need clarification, please call our National Customer Service Center(NSCS) at 1-800-375-5283 (TTY) 1-800-767-18-33). This toll-free call center has additional information and, during their specified office hours, can connect you to live assistance in English and Spanish.

* Submit all supporting tax documentation (W--2s, 1099s, etc) submitted to the Internal Revenue Service (IRS) from the petitioner/sponsor on form I-864, Affidavit of Support, for the most recent year.)

My mother in law is my co sponsor and Im pretty sure we submitted all the documents they need, that is why I dont know what to send. Also, what is "1099s"?

Anyone can tell me what to send?

Easiest thing to do is contact the IRS and obtain tax transcripts for both the sponsor and co-sponsor. Also include a copy of her passport photo page as proof of her US citizenship.

We sent them a copy of her birth certificate, she doesnt have a passport, I guess we'll need to re-send it. So, we just call the IRS and ask for the "tax transcripts"?

USCIS has been known to ask for things twice. I sent them a copy of my visa, and they still sent me an RFE asking for it.

So just re-send whatever they ask.

A 1099 is a form that shows your income other than what is on your w-2 from your employer.

Normally a 1099 is for self employement income. But a bank may also send a 1099 for interest.

If your co-sponsor didn't receive a 1099, then don't worry about it. Not everyone gets these.

That's why I think you should try to go to the local IRS office nearest you.

I've heard some people here on VJ did that and were able to get transcript in a week or so.

Some might have even gotten it printed for them right then and there at the office, if I remember correctly.

This is the form for ordering tax transcripts. http://www.irs.gov/pub/irs-pdf/f4506t.pdf

You can fax it in or even call. The numbers are on the last page and go by your state of residence. For item #6, you fill in the form 1040 and you check the box 6a. If you have a fax machine, they can fax the transcript back to you.

Mother will have to do her own. Also, her birth certificate must show she was born in the US. If not, you have to send something that shows she is a legal resident or a US citizen now.

A retired person would get their retirement or pension income shown on a 1099-R instead of a W2. Investment income is shown on a 1099-INT or 1099-DIV. There are a number of versions of 1099s.

I getting worried, what is a "Schedule C"??

Profit or Loss statement for a business. People who own a business or are self-employed must claim their profits as income, and can deduct their expenses as losses. I have a part-time home-based business, and I have to attach a schedule C to my tax return.

If you are using transcripts from the IRS then the data from the schedule C (if it was required with the tax return) will be included on the transcript. If you are using a copy of the tax return then it must include every form and document that would be submitted to the IRS. Some people make the mistake of thinking that "copy of your tax return" means only the 1040 form.
